Bradney and Binns v. Captain Herbert. —Claim £7 la, alleged to be due under an arrangement made between plaintiff and defendant thab the former - should tow the Acacia down to the Thames. Ib was stated that defendant had afterwards engaged another boab to do the work. Mr Buddie appeared for the plaintiff and Dr. Laishley for the defendant. The defendant in his evidence stated that the weather was so boisterous that he did nob think the plaintiffs boat was capable of getting them ; away, so be went to the Devonport FerrY Company and arranged with Mr Alison for a tow by the Eagle.
