Tine Courb resumed at 10 o'clock this morning. Alleged Sheep Stealing. —Tawihana Kenawe was charged wibh having, on the 30th of August 1889, stolen one ewe belonging to Thomas H. Tile, ab Opotiki.— Accused pleaded not guilty.—Mr J. A. Tole appeared oa behalf of bhe Crown, and Mr E. Dufaur for the priaoner. In opening the cas'a for tho" proaecution, Mr Tole explained thab tho reason four years had elapsed before the prisoner waa arrested, was because a summons waa. taken out againsb the prisoner ab the time, and he fled to the Ureweva country. — Isaac Walker deposed that in August, ISS9, he was ploughing on his father's land, when he saw tbe accused drive Mr Pile's sheep into a corner. He ; caughb one and carried it into some rushes. : Prisoner then went to a whare where some other natives were staying. Witness waa four or five chains away, but he had no doubt aa to the identity of tho accused. Iv tho evbning witness wenb to the wharo and saw some mutton hanging up. In tho rushes he found loops of flax with hair on them, as if they had been used to tie a sheep. Near the creek he found a sheep skin which had on ib Mr Pile's earmark. Pn answer to Mr Dufaur the witness aaid that a Mr Hood had sheep adjoining the paddock where Mr Pile's sheep were Tuning. The fence was good, but he would not swear Mr Hood'a sheep could not gob through. The brand on Mr Hood's shoep waa a different one to thab on Mr Pile'a sheep.—Thonas Hunter Pile gave evidence regarding the brand on hia c-heep. lie could not awear to the skin he saw, as it had been eaten by rats. Mr W ralker, however, knew hia sheep af woll aa he did. He had nob authorised any native to take a sheep.— In opening the case for the defence, Mr Dufaur pointed out that tho whole caae rested upon bbc evidence of ona witness.— The accused being sworn, denied that he had baken the shoep and killed it.—Counsel addressed tho jury, and Hl3 Honor waa summing up the evidence when we wenb bo press.
