GOLDWATER V. GREENWAY.

THE CASE SETTLED.

At the Supreme , Court to-day before Mr Justice Conolly Myer Goldwafcer sued Alfred Roberb Greenway for £318 10s, money lent. Dr. Laiahley appeared for the plaintiff, instructed by Mr C. S. S. George, and stated that nob only had the amount claimed been settled, but the whole of Mr Goldwater's claims against the defendant had been settled, including the amounb now sued for. The whole amount of £663 had been settled for £460 including costs.

Mr Theo. Cooper, who appeared for the defendant, instructed by Mr J. Haultain, stated that so far as the present action was concerned the plaintiff had accepted £16110s. RAE V. GREENWAY. Mr Theo. Cooper, who had appeared for the defendant in this case, applied that the , jewellery exhibits put in by defendant's witness should be handed over to de* fondant's solicitor.

Hia Honor said that of course the p.n. and 1.0.U.'a would certainly be delivered up.

Mr Cooper said all he asked at present) was that the jewellery exhibits should be delivered up, excepting tbab put in by Mrs ,| Hitchens. The other jewellery was handed , by Bowden to defendant's solicitor, who was therefore responsible for it.

Hie Honor said he would ba prepared to give all up when applied for.

Mr Cooper said that he would decline to have anything to do with the jewellery produced by Mrs Hitchens, as he had not put ' it in evidence.

His Honor said he would grant the order and the other would be delivered up to Mrs Hitchens upon application being made. Mr Cooper asked in reference to the cheque-books and other documents produced by Mr Hitchens, that an application for their delivery should not be entertained unless the defendant was represented.

This was agreed to, His Honor remarking they did nob appear of much value to anybody.
