It appeared, from the evidence of Mrs Mann and her daughter, Mrs Alcock, that tho two prisoners wero togethor in a right-of-way off Hardinge street, when tho indecency complained of was coiniriitted. Tho time waa about four o'cloci in tho afternoon, and tho prisoners were in view ul a number of cbildron. Constable Bernard said both prisoners were under tho influence of liquor, and Greenway waa tho moro intoxicutod of tho two. They wore, however, not to drunk that they did not know what they were doing. Subsequently they went from Harding street to College Road together, when he arrested them—Mr Browning appeared for Greenway, and implorod the Bench to deal leniently with him. If he wero Bent to pri?on, the effect would be ruin to him. Ho occupied a gocd pofitiou in the community.—Mr Pierce said the Bench were sorry to ccc a man of Mr Greonway'a position charged with such an offence. They however, caw no difference between the guilt of the parties, although there was a previous record against the female prisoner Tho evidence showed that neither was so drunk as not to know what ho or she was doing, nnd that they had been ablo to walk from Hardinge-street to College Koad after the commission of tha offence. They saw no reason why tho punishment of one prisoner should be lighter than chat of the other, and prisoners must both go to prison for one month.

Lakoenv. — Benjamin Bennett, Huch Carr, and James Pollock pleaded guilty to a charge of stealing fiveshirts, value23s9d, the property of GeorgeFowlds.—Thiß was Carr's first offence, and he was sentenced to one month's imprisonment with hard labour — Bennett and Pollock, who were old offender?, were each ordered to gaol tor throe months.

Kkmanded.—Arthur Moat was charged with the larceny of a number of blocks and tackle, value £2 10s, tho property of Fred Lange. He desired a remand in the caee, and it was allowed to stand over for a week
