DAMAGES AWARDED
.MOTHER’S CLAIM AGAINST SON SYDNEY, June 21. The Full Court of New South Wales to-day held that a mother was entitled to recover damages from her son for injuries she suffered when her husband drove her son’s car negligently. Last February an Armidale Court awarded Mrs Jennie Reid Waugh £3OO damages against her son and the matter came to the Full Court on the son’s appeal.
The facts were that the .son lent his car to his parents to take his daughter to Armidale. His father was driving the car when it hit a tree. Mrs Waugh was unable to sue her husband, as husbands' and wives are not entitled to take common law actions against each other for negligence. The Full Court held that’ the son was legally liable because his father was acting as his agent when the accident occurred..
