AN APPEALUPHELD. CASE. OF STIRLING LADY. DUNEDIN, This Day. The decision of the appeal judges appointed by the Trotting Conference to hear the appeal of Mrs M. Clark, of Winton, owner of the trotter Stirling Lady, against the decision of the New Zealand Trotting Association, dismissing her appeal from the decision of the Wyndham Trotting Club is an—nounced. The judges, Messrs B. S. Irwin, A. C. Haulen and J. S. Sinclair, upheld the appeal, ordering the return of the deposits made by appellant for the appeal, and referred the question of costs to the Trotting *CiODfCI‘enCC. Their conclusion was that the pro—ceedings which purported to be an in—quiry by stewards of the club consequent upon an objection made by a stipendiary steward were irregular and ultra vixres. Quite apart from this conclusion, the judges state that appellant could succeed on other grounds. The facts are that in the concluding race at the Wyndham meeting, Stirling Lady beat Pot Luck, but the judge’s placings were reversed by the judicial committee on the ground that Stirling Lady bored in _the final stages. The club’s decision was upheld by the Trotting Association, whereupon the present proceedings were taken.
