OWNER’S APPEAL DISMISSED.

(United Press Association—Copyright) (Deceived This Day, 1.50 p.m.) SYDNEY, This Day.

The Australian Jockey Club Committee has dismissed the appeal of H. M. Bate against his disqualification in connection with Nightful, but reduced his punishment to a fine of £lO.

A message from Sydney on July 12 stated: After an' inquiry into the nomination of the gelding Nightful for a recent provincial meeting, a steward reported that while A. E. Smith, who figured as the trainer, had been taking the horse to the track, George Carter, a well-known jockey, was its real trainer. Accordingly Smith, Carter and H. M. Bate, owner of Nightful, were disqualified for 12 months under the Improper Practices Pule. In a further inquiry into a betting transaction in respect of Nightful, the stewards found Carter guilty of dishonest and improper practices, and he was disqualified for two years, to be cumulative on the 12 months imposed on the other charge.
