FARES NOT PAID

TWO MEN CHARGED. TRAVELLED IN RAILWAY WAGON MAGISTRATE’S COURT CASES. The sitting of the Ashburton Magis* trate’s Court this morning, presided over by Mr 0. R. Orr Walker, S.M., lasted about 45 minutes. W. Reid and C. M. Reid were charged with having ridden on a train without having paid the iare, 16s 2d. They did not appear. It was stated that the men had been discovered in a wagon at Ashburton after travelling from Dunedin. They had stated they had no money to pay the fare. Each was fined the amount of the fare and 10s costs. Echo of Fatal Accident. Gertrude Fitzgerald was charged with having employed Gerald lnczgerald to drive a traction engine, lie not being the holder of a driver's certificate. Gerald Fitzgerald was charged with having driven a traction engine when he was not the holder of a certificate. Defendants were represented by Mr . W. Russell, who entered a plea or guilty in each case, and stated that tlie defendants were making voluntary appearances. The case arose out of the fatal accident on the Mitcham Road tivo months ago. Mr Russell said there had been no suggestion of incompetence on the part of the boy Fitzgerald, who had on frequent occasions taken charge of the engine during the absence of his father, who usually had charge. The Magistrate said it did not appear to involve negligence. Sergeant .W. T. Kelly said that really, was the point, for the engine was taken to a part of the road wlieie it had no need to be taken. The Magistrate said he would not connect the accident with the fact of there being no certificate. Mrs Fitzgerald was fined 20s, with 3s costs, and the other defendant was ordered to pay 3s costs. . No Light on Car, Arthur Edward Draper was fined 20s, with 10s costs, on a charge of having driven a motor car at night without lights. Civil Business. Judgment for plaintiff by default was given in each of the following, cases:—• A. L. Jones (Mr Drury) v. D. Norton, £2 Is 6d, with £1 costs; Ashburton Power Board (Mr Nicoll) v. A. R. Hunter, £1 10s 2d, with 9s costs; Same v. W. H. Parks, £3 10s 4d, with £1 5s 6d costs; Same v. F. Rose, £4 7s 6d, with £1 4s 6d costs; Same v. H. M. Tinkler, £3 lls 4d, with £1 5s 6d costs.
