ALLEGED LIBEL.
“WIZARD’S” CLAIM FOR £20,000= * FURTHER EVIDENCE HEAR D. (United Press Association —Copyright) SYDNEY, October 26. In tho case in which 'Wizard Smith is claiming £20,000 from “Smith’s Weekly” fey alleged libel, Ludwig Nudi, who accompanied plaintiff to Ninety Mile Beach as ignition expert, was cross-examined .about the reasons for the violent estrangement between himself and Smith. He replied “I had criticised a reporter for sending a wrong report concerning the state of the beach to the ‘New Zealand Herald.’ I told him it was a deliberate lie to say that the beach was bumpy and full of shells and washouts, when it was in perfect condition. The reported answered that it had nothing to do with him, as Smith had signed the telegram.” Mr Holman, K.C., counsel for the defence, claimed that the real reason for the estrangement was due to Smith giving certain instructions after seeing the articles that this witnes*s had furnished to the New Zealand Press. Donald Harkness designer of Smith’s car, gave evidence that the car had a gear ratio sufficiently high to break the then record of 245' miles an hour. The case was adjourned.
