THE DUNEDIN ARCADE CASE. (Per Press Association.) DUNEDIN, This Day. The decision of Mr Justice Adams in the Roval Arcade case was promulgated this morning. He has decided that the people of Dunedin have not established a public highway through the Arcade.

Action was taken by the AttorneyGeneral. acting for the citizens, against the Arcade Company, seeking a declaration that the Arcade was a public highway. His Honor, -after a lengthy review of the facts, held that all the evidence was consistent with the view that the public uses had been by permission of the persons in possession, and in that view only was the inaction of the public and the Corporation since . the year 1866 satisfactorily explained. Plaintiff had .failed to establish dedication, and the action was dismissed with costs.
