RAILWAY APPEAL CASES.
SITTING AT DUNEDIN.
DUNEDIN, June 15. The Railway Appeal Board, District Judge Haselden presiding, yesterday heard an appeal by Guard J. A. Shiels against the infliction of a fine of £5 | for negligence m connection with the breaking away of two loaded trucks from the Caversham tunnel works: The trucks charged- away with brakes off, and were not stopped until they reached Dunedin station. Appellant claimed that there was -no negligence" on his part. J. Graham Campbell, a tablet* porter on whose part negligence had been shown m connection with the same occurrence m riot haying the stop block on the brancK lino locked, and who was fined £5, also appealed,' b'ri the ground that he had not been given an opportunity of defending himself; He had been suspended and, fined'oij admission made^ him. at the enquiry into the breaking away of the trucks! In- both instances decisions were re^ served. ; Robert Millar appealed against disr missal from the position-of-labourer m the Hillside, workshops on .the .grounds of the Department's vaptidn,that,there was general inefficiency for;./work! LengtV- evidence w;as taken, arid th 4 decision was again reserved.,. . '. j Edward Isaac Keyes lodged an ap-r peal on the grounds; that her;hadbeeii superseded by other; porters m the:m'atter, of promotion. .The department's; case was that,he had not shown: duel capacity • for the position' of shunter when m that position at B.aloluthai! Evidence T was tendered, by the J. Department from the stationmasters ;underj whom appollant' previously served ad j shunter, and the opinion-Was by ;• them that he was^ noti physically equal to the work. Appellant protost-j ed that he was quite capable, of doing; the work, but the Judge.' hsd that, under the circumstances,, he could not see his way to interfere with the position, ' . ',■.;,■■.
