A Debt Cask. —In answer to an application made by plaintiff's counsel for an adjournment of a month in a judgment summons case at the Magistrates' Court yesterday, so as to allow defendant to pay the remaining portion of the money, Mr C. A»-Wray, S.M., paid that Buch an adjournment, with concomitant payment in driblets, was not within the spirit of the Act, Action in such debts must be of a decided nature one way or the other. Mr Buchanan said the application was for the convenience of the defendant, who was willing to pay, -and"had- already paid a portion. He recognised that an adjournment was wrong in principle. The Magistrate Raid it seemed to savour of the plan of keeping the sword dangling over a debtor, but, if the adjournment was at the defendant's request, he did not know that he would be right in refusing it.
