In ths Supreme Court a curious case is proceeding, Saunders ▼ Cabot. It is an action to compel the performance of an agreement. Plaintiffs (two sons of the late James Saunders alias*‘Jimmy the Needle,” former ferry man at the Waitaki, by his wife Wixon, a Maori halfcaste) allege that in 1869 Cabot, a farmer in Timaru, sold town section 19 to deceased for L3O ; that he subsequently earned the agreement and bad had possession of the section, now of great value. It was sought to compel the defendant to carry out the agreement, and restore the land, with all the profits, rents, etc., since accrued. Verdict. Dunedin, To-day. In the Police Court to day James Mabin, a runholder at Banmore, was charged on remand with having attempted to set fire to some stacks on the farm of a settler named O’Donnell. After further evidence had been taken as to, the character of the prosecutor, the Bench dismissed the information, holding that a primd facie case had not been made out. He considered that Mabin’s witnesses had proved that he was at home on the date when he was said to have been seen at the stacks, and pointed out that O’Donnell’s evidence was uncorroborated. Accumulated Grain. At a meeting of grain shippers held here to-day to discuss the inadequate shipping facilities supplied at the Bluff by the Union Company for the carriage of grain to the Australian ports, it was stated that nearly 100,000 bags of grain were now lying at port awaiting shipment, and suggested that a special steamer should be chartered for its export. Ultimately the following resolution was carried — “ That in the opinion of this meeting, weekly provision of space for grain in outward Melbourne steamers has been totally inadequate throughout the season to the requirements of the port, and that a strong representation be made to the Company to clear off accumulated stock, and to aiterwards make a fair provision for the port.
