RESIDENT MAGISTRATE'S GOURT

Wednesday, October 24, 1860. [Before J. Poynteb, Esquire, Resident Magistrate.] Buxton v. Thomas, for £2 9s. 6d. Mr. Buxton claimed the above sum for broken goods. They were put on board the John Phillips in good condition. Judgment for £1 10s., with 9s. costs. Edwards $ Co. v. Thomas, for £7 10s. This was for a hogshead of draught ale, from which several gallons had been abstracted. Thomas Hill sworn: Am landing waiter at the port of Nelson. Received a warrant to bond ten hogsheads of ale ex John Phillips. Found one of the casks had been spiled about nine inches from the head. There there twelve gallons deficient; the beer had leaked out to the line of the spile, from which there was a continual dripping. Believe it was done on board ship. E. Buxton sworn: Am importer of goods from England. 1 consider that a cask partially full would in the course of a very little time turn sour ; it is only fit now for immediate sale. The Magistrate said the captain must pay for the actual loss, £1 45., costs 15s. Askew v. Ilorlin, for £17 7s. 3d. Judgment for the amount, with costs. LocJceitrv. Gough, for £4 19s. 9d. Judgment for plaintiff, with costs. Bush v. JBeauchamp, for £14 6s. 6d. Debt admitted, but a contra account, amounting to £J7 125., was produced. J. W. G. Beauchamp sworn : Was employed by Mr. Bush to make a survey in October 1856. (Plans produced.) Mr. Bush nai anxious to have a canal cut from the Mill to Green I'oint. It was to be done by a certain day, and I engaged Mr. Lewis to help me. The whole came to £16 25,, in addition to.which I sold Mr. Bush a coat for.£«. 10s.

Henry Lewis sworn: Assisted Mr. Beauchamp in making a survey in October, 1856. Always understood that Mr. Bush ordered the survey. Consider the charge a fair one. In defence Mr. Bush said that the agreement he made was that if a certain Company should be formed they would pay for the survey, and if not no charge was to be made.

The Magistrate spoke of the loose manner in which Mr. Bush kept his books, and gave judgment for defendant, £3 ss. 6d.
