REGULATIONS UNDER THE REGULATIONS ACT, 1936

Serial Number 1944/168 / THE WARRANT OF FITNESS EMERGENCY ORDER 1944 _______, - (NO. 2) - -' Pursuant to the Transport Legislation Emergency Regulations 1940,* the Minister of- Transport doth hereby make the following Order. ORDER 1. This Order may be cited as the Warrant of Fitness Emergency Order 1944 (No. 2). 2. The Warrant of Fitness Emergency Order 1944 f is hereby revoked. 3. While this Order continues in force clauses (1) and (4) of Regulation 11 of the Traffic Regulations 1936 J (as substituted by Regulation 7 of the Traffic Regulations 1936, Amendment No. I§, and as amended by Regulation 4 (a) of the Traffic Regulations 1936, Amendment No. 3||) shall be suspended, and the following clauses shall be substituted therefor : .. “ (1) Save as provided in clause (4) hereof, no person shall operate a motor-vehicle on a road unless there is carried in the vehicle a warrant of fitness in the form prescribed in the First Schedule hereto issued in respect of that vehicle and disclosing thereon a date of examination not earlier than “ (a) Twelve months before such operation in the case of a trailer or a motor-cycle, or in the case of a motor-car which is correctly insured under Class 4 for the purposes of the v _ Third Schedule to the vehicles Insurance (Thirdparty Risks) Regulations 1939^}; and “ ( b ) Six months before such operation in the case of any other motor-vehicle, — and the driver or person in charge of the vehicle shall produce the warrant for inspection on demand by any police officer or traffic inspector. The warrant of fitness shall be issued only by a city authority or a person or firm appointed or approved for the purpose by the Minister, and such appointment or approval shall be notified in such manner as the Minister directs. With the prior written consent of the Commissioner a warrant of fitness may be issued to a vehicle not equipped with lamps as required by Regulation 7 hereof if such warrant is expressed to be subject to both of the following conditions —namely, first, that no head-lamps shall be fitted to the vehicle, and, secondly, that* the vehicle shall not be operated during hours of darkness. The existence of such a warrant shall excuse non-compliance with Regulation 7 hereof, but no person shall, if the only warrant of fitness carried in a motor-vehicle is one containing the conditions herein specified, operate that vehicle on a road in breach of either of those conditions. “ (4) This regulation shall not apply to any vehicle for which there is in force a certificate of fitness issued under the Transport Licensing Act, 1931, or a permit granted under that Act for the vehicle to be used without a certificate of fitness.” Dated at Wellington, this 11th day of December, 1944.
