Circular No. 6/44] Returns for Police Gazette Return of Persons dealt with at Supreme Courts (Form Police 53) These returns are to be prepared as soon as possible after offenders have been dealt with by the Courts. Particulars of prisoners sentenced between fixed criminal sittings are to be entered on returns and forwarded as early as possible and not held over until conclusion of the next fixture of the Court. Where an offender has been committed for trial from the Lower Court, the date of trial to be shown on form 53 should be the date of the commencement of the particular Sessions, and where an offender is committed for sentence from the Lower Court, the date he is actually sentenced by the Supreme Court should be shown. If this is strictly adhered to the date of trial recorded in the Police Gazette shortly after the offender is dealt with, will, having regard to the provisions of section 34, Prisons Act, 1908, agree with the date of trial shown on form Police'B4 when the prisoner is discharged from prison. The offences are to be clearly defined and breaking and entering offences shown as “ burglary,” “ housebreaking,” shopbreaking,” “ warehouse-breaking,” &c., as the case may lie. ... - ; When prisoners are sentenced and the presiding Judge warns an offender that he has qualified to be declared an habitual criminal, a note that such warning has been administered is to be entered on this return. If at any subsequent date a prisoner who has been so warned is brought before the Supreme Court for trial or sentence, a similar note is to be made on the Conviction List compiled for the Court. Also, when the Supreme Court, in releasing an offender on probation, imposes a special condition that he shall take out a prohibition order, the fact of such condition having been imposed is to be entered on the return. When offenders are dealt with for offences under the Motor-vehicles Act for which they are liable to be disqualified from driving, an entry is to be made as to whether or not a disqualification has been imposed, If disqualified, the period to be stated.

Return of Persons summarily convicted at Magistrates’ Courts (Form Police 94) These returns are to be furnished each (Saturday from all stations where there have been cases during the week and must include particulars of persons convicted and not sent to gaol and those convicted and sentenced to imprisonment for fourteen days or more, but particulars of offenders on whom a disqualification has been imposed under the provisions of the Motor-vehicles Act are to be included on the return irrespective of the sentence passed. Offences are to be clearly defined (breaking and entering offences to be shown as “ burglary,”/ “ housebreaking,” “ shopbreaking,” &c.), and if there is any doubt as to the wording of the offence, the section of the Act or regulation should be quoted. The latter should always be quoted where the offence may apply to several Acts or regulations, such as “ false statement,” and “failing to notify change of address,” &c. When an offender is released on probation by the Court and a special condition that he take out a prohibition order is imposed, this fact is to be entered on the return. Also i i connection with offences relating to intoxication in charge of motor-vehicles or negligent or dangerous driving of such

vehicles, &e., a note is to be made whether or not a disqualification from driving was imposed. If. disqualified, the period is to be stated. In cases of theft the descriptions of the article or articles stolen and the value thereof are not to be entered on returns for Police Gazette.

Return of Prisoners discharged from Gaols (Police Form 84) These returns are to be furnished each (Saturday where prisoners have been discharged during the week and should include particulars of all such persons who have been sentenced to imprisonment. Particulars “of an offender who is fined by the Court and is subsequently imprisoned in default of payment thereof should not be entered on the return when particulars of the conviction have already been published in the Police Gazette.’ Should an offender be released from prison before the expiry of his sentence, an explanatory note is to be made on the return, and in maintenance cases, care is to be taken that the date the warrant of commitment was executed is given. General Careful attention should be given to descriptions of offenders (surname to be entered first), particularly in regard to height and age; the height of an offender must be measured without his footwear, so that it will agree with that shown on form Police 84 by prison officials, and where it is found that a description varies from that previously recorded in the Police Gazette in respect of the same offender an explanatory note is to be made on the return ; tattoo and other distinguishing marks should be shown despite the fact that they may have been previously recorded, and the latest Police Gazette and photographic references (if any) must be quoted. The dates of trial should be arranged in sequence on forms 53 and 94. It is essential that all information supplied on above returns forwarded for publication in the Police Gazette should be correct. The contents should be thoroughly checked by the member of the Force who compiles them, and where possible, in conjunction with another member.
