Serial Number 1942/301 THE LICENSING ACT EMERGENCY REGULATIONS 1940, AMENDMENT NO. 1 C. L. N. NEWALL, Governor-General. ORDER IN COUNCIL. At the Government House at Wellington, this 20th day of October, 1942. Present: His Excellency the Governor-General in Council. Pursuant to the Emergency Regulations Act, 1939, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.
REGULATIONS. 1. These regulations may be cited as the Licensing Act Emergency Regulations 1940, Amendment No. 1, and shall be read together with and deemed part of the Licensing Act Emergency Regulations 1940* (hereinafter referred to as the principal regulations). 2. The principal regulations are hereby amended by revoking Regulation 6, and substituting the following new regulations:— “6. (1) If the Minister issues any certificate under these regulations declaring that the license in force in respect of the premises shall not be suspended, the Minister may in the same or in any other certificate declare that the part of the premises which is in the possession of or being used by or on behalf of the Government or any local authority, or any portion thereof, shall not be licensed premises while the certificate remains in force, and in any such case the provisions of the Act relating to licensed premises shall not apply in relation to that part of the premises or that portion thereof, as the case may be. “ (2) If the Minister issues any certificate under these regulations declaring that the license in force in respect of the premises shall not be suspended and the Minister is of opinion that, by reason of the possession or use as aforesaid of part of the premises, the licensee will be unable to perform or observe any of his duties or obligations as a licensee, the Minister may in the same or in any other certificate declare that the licensee shall not be bound to perform or observe such of his duties or obligations as a licensee as may be specified in the certificate, and in any such case the licensee shall while the certificate remains in force be excused from performing or observing, those duties or obligations. “ 6a. Every certificate under these regulations shall take efiect from the date thereof or from such other date (whether before or after the date of the certificate) as may be specified therein in that behalf.” 3. Regulation 7 of the principal regulations is hereby amended by omitting the words “ or to so much thereof as is no longer in the possession of or being used by or on behalf of the Government or any local authority ”. 4. The principal regulations are hereby further amended by adding' the following new regulation thereto : . “9. The foregoing provisions of these regulations shall apply, with the necessary modifications, in any case where the whole or any part of any licensed premises is in the possession of or being used by or on behalf of the Government for any purpose whatsoever.” C.
