Pursuant to the Emergency Regulations Act, 1939, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS. 1. These regulations may be cited as the Oil Fuel Emergency Regulations 1939, Amendment No. 5, and shall be read together with and deemed part of the Oil Fuel Emergency Regulations 1939* (hereinafter referred to as the principal regulations). 2. The principal regulations are hereby amended by inserting, after Regulation 27, the following new regulation : “ 27a. If in any prosecution for any offence against these regulations it is proved or admitted that any oil fuel was purchased or sold, the burden of proving that the purchase or sale was in accordance with the provisions of these regulations shall be upon the defendant.”

3. The principal regulations are hereby further amended by adding the following regulations and headings :

“ Return of Oil-drums.

“ 44. (1) For the purposes of this regulation the expression * oil-drum ’ means a container having a capacity of approximately 44 gallons and designed principally to contain oil fuel. “ (2) Every person who at any time after the commencement of these regulations is for the time being in possession of an oil-drum that is owned by a person engaged in the business of selling oil fuel and is not being used for the storage of more than 8 gallons of oil fuel shall forthwith return' the oil-drum to the owner or to a person authorized to receive the oil-drum on behalf of the owner.

“ (3) Every person who fails to comply in any respect with the provisions of this regulation shall be deemed to have committed an offence against these regulations.

Pursuant to the Emergency Regulations Act, 1939, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS. 1. These regulations may be cited as the Police Force Emergency Regulations 1942. 2. In these regulations, unless inconsistent with the context, — (a) “ The Act ” means the Police Force Act, 1913 : “ Member of the Force ” includes any person employed in the Force, whether his employment commenced before or after the coming into force of these regulations : “ Minister ” means the Member of the Executive Council for the time being charged with the administration of the Act. ( b ) Except as hereinbefore provided, terms defined or used in the Act have the same meaning as in the Act. 3. The Police Force Emergency Regulations 1941* are revoked. 4. So long as these regulations continue in force, and notwithstanding anything in the Act or any other provision of law to the contrary, no member of the Force shall be entitled to resign from the Force otherwise than as herein provided, and no purported act or instrument or notice of resignation shall have any force or effect except so far as it may take effect as an application under Regulation 5 hereof, nor shall any act of desertion terminate membership. 5. Any member of the Force desiring to be discharged from service in the Force may make application in writing in that behalf through his immediately superior officer and the Commissioner to the Minister. 6. The Minister may in his absolute discretion elect either to grant or to refuse his consent to the application, and if he elects to grant his consent may impose such conditions. as to date of discharge or otherwise as he thinks fit. 7. If the Minister elects to grant his consent to the application, such consent, together with any conditions imposed by the Minister, shall be notified in writing by the Commissioner or by direction of the Commissioner to the person concerned, and on -the happening of the conditions, if any, so imposed, or if no conditions are imposed, then at the expiration of the day on which such notification in writing is received by the said person he shall cease to be a member of the Force.
