C. L. N. NEWALL, Governor-General. ORDER IN COUNCIL. At tlie Government House at Wellington, this 23rd day of May, 1942. Present: His Excellency the Governor-General in Council. Pursuant to the Emergency Regulations Act, 1939, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS. 1. These regulations may be cited as the National Service Emergency Regulations 1940, Amendment No. 11, and shall be read together with and deemed part of the National Service Emergency Regulations 1940* (hereinafter referred to as the principal regulations). 2. Regulation 44a of the principal regulationsf is hereby amended by adding to clause (4) thereof the words “ Where any Magistrate on the application of any person authorized in that behalf by the Minister is satisfied that the presence of any defaulter in a detention camp is prejudicial to the good order and discipline of the camp, the Magistrate may order that the defaulter be detained in a prison, and while he is so detained the provisions of the Prisons Act, 1908 j;, and of any regulations made thereunder shall apply to him as if he had been sentenced to imprisonment with hard labour. Any defaulter detained in a prison pursuant to this clause may be transferred from prison to a detention camp by direction of the Minister. The detention of any defaulter in a prison pursuant to this clause shall for the purposes of these regulations be deemed to be defaulters’ detention.” C. A. JEFFERY, Clerk of the Executive Council.
