Memorandum.] Low Flying by Aircraft. The attention of members of the Force is directed to my memorandum of 2nd July, 1940, published in Police Gazette, 1940, page 541, instructing that members report particulars of any instances of low flying by aircraft which they may witness. The Air Department advises that there arc indications that there are still many cases of unauthorized low flying by pilots of the Royal New Zealand Air Force. The attention of contributors to the Superannuation Fund is drawn to the provisions of the Finance Acts (Nos. 2 and 4), 1940, and the regulations issued thereunder, which enable a contributor, within three months preceding his retirement, or after his retirement but before he has accepted the first instalment of a retiring-allowance, to surrender portion .of his retiring-allowance to ensure an annuity for the rest of her life to : —“ {a) His present wife ; or (b) An approved dependant other than his wife. 2. Also he may, either in conjunction with the provision mentioned or independent of it, elect to accept a reduced allowance after the death of his present wife (or approved dependant) in consideration of an increased annuity being paid to her should he die first.

3. It is to be noted that a woman who is a superannuitant may exercise an election in favour of her present husband or an approved dependant.

4. In the exercise of this right of election certain conditions operate, viz (a) A written request must be made by the superannuitant to the Board and the necessary particulars supplied. A Form of Application for this purpose is available upon request. b ) The appropriate information, and forms of Election and Medical Certificate, will then be supplied by the Board. (c) The Board nominates a medical examiner, but the applicant may, if he so wishes, in his Form of Application nominate his own, which the Board may or may not concur in. If the Board nominates a different medical examiner, the applicant may be examined by both doctors or by the Board’s nominee, as he pleases. In any case the required medical examination is at the cost of the applicant. d) There is provision for a second or later medical examination of the applicant if thought fit, the cost of which is payable by the party requiring it— i.e., the Board or the applicant. (e) A person may not elect to provide his nominated annuitant with an annuity greater than the allowance retained by himself. In the case of a widow this takes into account the £3l per annum to which she continues to be entitled.

5. A person may revoke his election either before retirement or before any instalment of his allowance has been received by him, and if he so wishes (within the period allowed) may then make a further election.

6. An election is automatically revoked if the contributor should die before the date fixed for his retirement or if the nominated annuitant should die before the retirement or before any instalment of the allowance has been received by the applicant. In the latter contingency, the contributor may, if he so wishes (within the period allowed), then make a further election.

7. Once an election has become effective the widow loses her right of taking a refund of contributions in lieu of her normal £3l per annum, as this is added to her annuity, whilst the right of personal representatives to a refund of a person’s credit balance is deferred until the death of the survivor, and all outgoings up to that moment are taken into account.

8. Provision is made to meet the case of a contributor who is at any time entitled to retire through age or length of service, but who remains or who is retained in service beyond that time. He may make an election and be medically examined as at the time he becomes entitled to retire, and if the report is satisfactory the election remains good until ultimate retirement without further medical examination.

The following conditions, however, operate in any such case—

(а) The contributor wishing to make the election must obtain the approval of the Public Service Commissioner (in the case of a contributor under his control), or the Minister of Education (in the case of a contributor to the Teachers’ Superannuation Fund), or (in any other case) the Minister in charge of the Department concerned. (б) The election is irrevocable by the contributor. (c) Should the contributor die before actual retirement, the election will operate in favour of the nominated annuitant.

(d) Should the nominated annuitant die before the actual retirement, the contributor must abide by the terms of the election.

9. If any contributor had at the date of passing of the amending Act (6th December, 1940) become qualified to retire by reason of age or length of service, but had at that same date been retained in service at the wish or direction of his Department, he is advised to communicate at once with the Board.

10. The value of £1 per annum has been computed over a wide range of ages, and as a general indication of the effect of these provisions the specimens below are given : Case A. —Where the election is to operate immediately upon retirement, each £1 per annum of allowance surrendered will secure to the approved annuitant the following annuities :

Case B. —Where the election is a contingent one, each £1 per annum by which the contributor agrees to reduce his allowance in the future in the event of the approved annuitant predeceasing him will secure to the approved annuitant, in the event of the contributor dying first, the following annuities: — .
