Statutes Amendment Act, 1939—Amendments to Police Offences Act.

Police Offences.

56. This section and the next three succeeding sections shall be read together with and deemed part of the Police Offences Act, 1927 (in those sections referred to as the principal Act). 57. (1) Except with the consent of the GovernorGeneral in Council or as expressly provided in any Act other than this Act, no association of persons, whether a body corporate or not, shall exercise the functions for which it is formed under a name which — ( a ) Contains the word “ Royal ”, or “ Imperial ”, or “ Parliament ”, or “ National ”, or “ State ”, or any word which suggests, or is calculated to suggest, the patronage of His Majesty or of any member of the Royal Family or connection with Parliament or with His Majesty’s Government or any Department thereof; or . ( b ) Contains the word Municipal ’, or “ Chartered ”, or suggests, or is calculated to suggest, connection with any municipality or other local authority, or with any society or body incorporated by Royal Charter; or (c) Contains the word “ Bank ”, “ Bankers ”, “ Banking ”, “ Co-operative ”, “ Trust ”, or “ Trustee ”, or the words “ Stock Exchange ”. (2) Where any Act provides for the registration of any association of persons, the registering authority may refuse registration if in its opinion the use of the name by which the association desires to be registered is prohibited by the last preceding subsection. (3) The provisions of this section shall, with the necessary modifications, apply to an individual carrying on business under any name or style other than his own.

(4) Any association or individual who does any Act in contravention of the provisions of this section commits an offence and shall be liable on summary conviction to a fine of fifty pounds. (5) Nothing in this section shall apply to the use by any association or individual of any name that was in use in New Zealand by- that association or individual on the passing of this Act.

Restriction on use of certain names.

58. Section forty-one of the principal Act is hereby amended as follows: (a) By omitting from paragraph (a) the words “ and in default of payment thereof may be imprisoned for any term not exceeding forty-eight hours”: (b) By omitting from paragraph (b) the words “ and in default of payment thereof may be imprisoned for any term not exceeding seven days ”: (c) By omitting from paragraph (c) the words “ and in default of payment thereof to fourteen days’ imprisonment 59. (1) Every person who, having the control or management of any dance being held in any hall, supplies intoxicating liquor to any person in the hall, or permits any liquor to be taken into or consumed in the hall, commits an offence and is liable on summary conviction to a fine of twenty pounds. (2) Every person who, while a dance is being held in any hall, drinks any intoxicating liquor in the hall, or has any liquor in his possession or control in the hall or in the vicinity of the hall, or supplies liquor to any person in the hall, commits an offence and is liable on summary conviction to a fine of ten pounds. (3) For the purposes of the last preceding subsection liquor shall be deemed to be in the vicinity of a hall wherein a dance is being held if it is shown that the liquor was in the possession or control of any person attending or proceeding to attend the dance, or was consumed or intended for consumption by any person so attending.

(4) Any constable who has reason to suspect that there is any breach by any person of the provisions of this section in or in the vicinity of a hall where a dance is being held may without warrant enter the hall, or any place in the vicinity thereof, and examine the same and search for intoxicating liquor therein and may seize and remove any liquor found therein and the vessels containing the liquor. Any liquor so seized in respect of which any person is convicted of an offence under this section, together with the vessels containing the liquor, shall be forfeited to the Crown. (5) Nothing in this section shall apply in relation to any liquor in any licensed premises or in any dwellinghouse.

(6) For the purposes of this section, — “Hall ” means any building where any public dance is held or where any dance is held to which admission is obtained upon payment of subscriptions, either in money or by way of supplying refreshments, and whether upon general or individual invitation, or otherwise: “ Intoxicating liquor ” and “ liquor ” shall have the meaning assigned to those terms by section four of the Licensing Act, 1908.

Offences in relation to intoxicating liquor at dances.

Special attention is directed to section 59. The utmost discretion must be used in administering its provisions. It is to be noted that it applies only to dances to which admission is obtained upon payment of money or the supply of refreshments. It is not intended to apply to private dances such as those given on the occasion of a wedding, birthday, or coming-of-age party. Much will depend upon the prudent exercise of the powers given. There should be no undue publicity or show of authority. Although it may be necessary to seize liquor as evidence, no force should be used to obtain it from the person of any offender. Indiscreet leniency tending to give the impression that the provisions of the Act do not serve the purpose intended and all acts giving occasion for justifiable complaint of tactless and harsh administration must be avoided. No prosecution under the section must be commenced without the leave of the officer in charge of the district, or an Inspector in the four main centres. A stationary motor-car in the vicinity of a hall shall be deemed a “ place ” within the meaning of the section, but no such car must be searched unless there are good reasons for believing that liquor is being consumed therein.

Collection of Agricultural and Pastoral Statistics.

The collection of Agricultural and Pastoral Statistics for the coming year will be wholly undertaken by the police. For this purpose members of the Force in charge of stations will be appointed sub-enumerators for their respective subdistricts. Each sub-enumerator shall be responsible for the collection of returns for all holdings in his sub-district that come within the scope of the inquiry.

The collection will commence in February or March according to locality, and will be completed as early as circumstances permit without undue interference with police duties. Lists of occupiers of holdings as returned previously will be supplied by the Government Statistician to sub-enumerators for their guidance in tracing holdings. Sub-enumerators are, however, to ascertain locally any changes of occupancy of holdings. Sub-enumerators shall collect returns personally from occupiers within easy reach without incurring any expenditure on account of meals or locomotion. In other cases the schedules are to be posted or otherwise distributed by subenumerators to occupiers for completion and return. Particulars on schedules shall be scrutinized by subenumerators and transcribed into collection-books for dispatch to the Government Statistician. For their services in checking lists, distributing and collecting schedules, and posting the details into the collectionbooks, sub-enumerators will be paid 6d. per schedule collected, less social security charge. Payment will be made by the Government Statistician to the sub-enumerator on completion of the collection in his sub-district.

No payment for meals or locomotion expenses will be made, and it is expected that all returns that cannot be obtained during the ordinary course of police duty will be collected by post. It is desirable, however, that sub-enumerators should get in touch with as many occupiers as possible and personally collect particulars from them to ensure accuracy of the returns.

Stamps required for postage or for payment of postage on schedules received from occupiers or for any necessary toll calls are to be requisitioned for on the local Postmaster, the Police Officer to sign as Sub-enumerator of Agricultural and Pastoral Statistics, and to make the claim chargeable to the Census and Statistics Office.

Correspondence on ordinary routine matters in connection with the collection shall be direct between the Government Statistician and the sub-enumerators. Communications regarding special points which may affect the Police Department shall be made through the usual police channels. A supply of books, schedules, and envelopes, together with full instructions as to the method of collecting and posting the returns, will be issued to sub-enumerators by the Government Statistician.

This Department has in the interests of economy agreed to the work being undertaken entirely by the police without the engagement of civilians in any district, and the co-operation of the members of the Force concerned is requested to make the returns as complete and accurate as possible.
