MISCELLANEOUS INFORMATION.

Memorandum.] General Election. (1) Duties of Police at Public Meetings. Officers in charge of districts and sub-districts are reminded that it is essential to give all possible attention to the preservation of order during the election campaign. The principal concern of the police must always be to preserve order. Where there is disturbance of meetings in halls where candidates and others are addressing the electors the police should adopt a firm attitude at the outset, so that disturbers may know what to expect. The greatest tact must be exercised. Notice need not be taken of occasional interjections and good-humoured banter, but organized attempts to prevent the speaker from being heardpersistent noise and “ counting-out ’’—should be checked. In such cases offenders should be at once warned that if they

persist in such conduct they will be required to leave the hall and will be prosecuted. Should any one so warned disregard the warning, he should be asked to leave the hall forthwith, his full name and address obtained, and an information should be laid against him the following day, and the case set down for hearing within a couple of days. An adjournment for a few days if asked for to prepare his defence can be agreed to. The case should be heard by a Magistrate if one is available. If no Magistrate is available, arrangements should be made for a hearing before Justices. Informations should be laid under section 3 (ee) of the Police Offences Act, 1927 (behaving in a disorderly manner in a public place). Where an offender refuses to give his name and address he may be arrested. Should his name and address be ascertained when he is in custody, he should be released on his own recognizance to appear at the first sitting of the Court. In places where the Court does not sit daily a special sitting should be arranged.

A hall in which a candidate addresses electors would seem to be a public place within the meaning of section 40 of the Police Offences Act, 1927. Should any Court hold that any such hall is not a public place, the matter must be reported to this office without delay." Newspapers containing reports of disorderly or disturbed meetings or other disorder in connection with the elections should be forwarded direct to this office by the member of the Force in. charge where such meetings are held or disorder occurs.

At important meetings care is to be taken that a sufficient number of police is in attendance. It is not advisable to make a display of uniform men at public meetings, but if, in addition to those in uniform, a few are scattered among the audience (in pairs) in plain clothes, it will be easier to detect disturbers who overstep the mark, and to prove the offence.

(2) Election Day : Duties of Police. Officers in charge of districts shall see that members of the Force detailed for duty at polling-places are thoroughly instructed in their duties for that occasion. One or two lecturedays should be devoted to giving instruction on these duties. The following statutory provisions apply in respect of their conduct and of the duties and responsibilities directly imposed, or which may indirectly devolve, upon them - / The Police Force Act, 494Jrsnction-24. / , /3 2The Electoral Act, 1927, sections 117,*"119/ 128; 130/ 131, 158, 159/ 161 to 164 (inclusive), 166, 167, 225 to 233 (inclusive), and section 3 of the Electoral Amendment Act, 1934. It is to be observed that there is no power to arrest for offences except that conferred by section 158 (a) respecting offences specified in section 164, and by section 167 in respect of personation. In all other cases the names and addresses of the offenders are to be obtained. Whatever evidence is available on the spot is to be noted with a view to assisting the Returning Officer. Section 39 of the Licensing Act, 1908, should be read in ... conjunction with section 128 of the ""Electoral Act, 1927. P&ft It is to be particularly noted only the sale of liquor between £ 12 noon and 7 p.m. is prohibited by these sections. The licensed houses are not required to be closed ; hence section ■' 194 of Licensing Act, 1908 (making it unlawful for certain persons to be on licensed premises when closed) does not apply until 6 o’clock.

(3) Maori Representation : Elections. These elections will be held on the day before the general election. Attention is directed to section 186 of the Electoral Act, 1927, as amended by the Electoral Amendment Act, 1937, and in particular subsections (1) (gg), (M), and (2), also sections 192 to 194 (inclusive). The latter section makes it unlawful to sell or supply any intoxicating liquor to any Maori on the day on which any election is held for a Maori electoral district. Subject to this, licensees may carry on their business as usual. Attention is also directed to section 5 (g) of the Electoral Amendment Act, 1937. The foregoing instructions ‘ are in substitution of those published in Police Gazette, 1928, pages 718 and 719, which are hereby cancelled. D. J. Cummings, Commissioner of Police.
