Serial Number 1938/95. The Fitness Certificate (School Motor-car) Exemption Order 1938. GALWAY, Governor-General. ORDER IN COUNCIL. At the Government House at Wellington, this 3rd day of August, 1938. Present : His Excellency the Governor-General in Council. Pursuant to section 27 of the Transport Law Amendment Act, 1933, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following Order : 1. This Order may be cited as the Fitness Certificate (School Motorcar) Exemption Order 1938. 2. Passenger-service vehicles of the class set out in the Schedule hereto are hereby exempted from the requirements of section 38 of the Transport Licensing Act, 1931, as to a certificate of fitness being in force with respect to such vehicles while the same are used in connection with a passenger-service.

SCHEDULE. Class of Exempted Vehicles. Any motor-car, as defined in section 2 of the Motor-vehicles Act, 1924, if in the carriage of passengers for hire or reward it is used solely for the transport of schoolchildren not exceeding seven in number and not exceeding by more than two the designed adult passenger-carrying capacity of the motor-car.
