Accused obtained scrap-metal, value £1 45., from Robert Leith, engineer, High Street, by falsely representing that he was a traveller for Brown and Dureau, Wellington, and that he was authorized to purchase the metal on their behalf. Madden, age about thirty-eight, height about 5 ft. 6 in., agent, native of Australia, strong build, fresh complexion, light-brown hair; dressed in a light-brown suit and brown hat and shoes, and he may be wearing tortoiseshell glasses; bustling manner. Accused obtained a Nash sedan motor-car, registration No. 83-721, from Robert McGuire, 30 May Street, by falsely representing that he was a man of substance and that he owned a printing business in Cuba Street, and resided at the Bristol Hotel, Wellington. He paid £25 deposit, and arranged to give three promissory notes of £25 each, the first to be handed over on Ist February, 1935. He was accompanied by his wife (who takes the name Ade Lake, and states that she was employed by J. C. Williamson’s, Sydney) and a man named Gael. Accused obtained the articles mentioned below from John Guest, storekeeper, Balclutha, by falsely representing that William Duke and Sons, Dunedin, were partners in his business : A pair of gentlemen’s shoes; a pair of gymnasium shoes; three shirts; three pairs of socks; a pair of garters ; a Nugget outfit; two pairs of underpants ; two singlets ; and a pair of trousers : total value, £5 10s. 4d. Portion identifiable. About the 17th December last, accused opened a shop in Clyde Street, Balclutha, and obtained smallgoods and other supplies from William Duke and Sons, butchers, Dunedin. After selling the goods, he committed the above offence.
