Regulations under the Motor-vehicles Insurance (Third-party Risk) Act, 1928. (See New Zealand Gazette, 1933, page 1224.) BLEDISLOE, Governor-General. By his Deputy, MICHAEL MYERS. ORDER IN COUNCIL. At the Government House at Wellington, this Ist day of May, 1933. Present: His Excellency the Governor-Gen in Council. IN pursuance and exercise of the powers conferred on him by the Motor-vehicles Insurance (Third-party Risks) Act, 1928 (hereinafter referred to as “ the said Act ”), His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the regulations under the said Act made respectively on the twentieth day of April, one thousand nine hundred and thirty-one, and the twenty-seventh day of April, one thousand nine hundred and thirty-two, and in lieu thereof doth hereby make the following regulations, and doth hereby declare that this Order in Council shall come into force on the date of its publication in the Gazelle.

REGULATIONS. 1. These regulations may be cited as the Motor-vehicles Insurance (Third-party Risks) Regulations, 1933. 2. (1) Except as provided in subclause (2) hereof, every insurance company willing to undertake insurance business in terms of the said Act shall give to the Registrar of Motorvehicles at Wellington, in the manner prescribed by section 4 of that Act, a notice in the form numbered 1 in the First Schedule hereto. (2) Every notice heretofore given by an insurance company under the regulations hereby revoked, and subsisting at the commencement of these regulations, shall continue in force until revoked in the manner prescribed by section 4 of the' said Act. 3. The nomination, pursuant to section 5 of the said Act, of the insurance company with which the contract of insurance in respect of any motor-vehicle is to be made shall be in the form numbered 2 in the First Schedule hereto. 4. (1) The notice of the sale or other disposal of a motorvehicle, required to be given pursuant to section 7 of the said Act, shall be given to the insurance company concerned by the former owner in the form numbered 3 in the First Schedule hereto. (2) Every person who, being required by section 7 of the said Act to give any such notice as aforesaid, fails to give such notice in accordance with the said section shall be liable to a fine of £5. 5. (1) The annual premiums payable in respect of contracts of insurance under the said Act for the year commencing on the Ist day of June, 1933, or for the year commencing on the same day in any subsequent year, shall be as set out in Part I of the Second Schedule hereto, and the classes of motorvehicles for purpose of insurance premium shall be those set out and described in the said Second Schedule. (2) When a contract of insurance in respect of any motorvehicle is entered into for a period of less than a year the amount of the premium as prescribed in the Second Schedule hereto shall be reduced by one-twelfth part thereof for every complete month by which the term of the contract is less than one year.

(3) Any premiums hereafter becoming payable for any period expiring before the Ist day of June, 1933, shall be fixed in accordance with the Motor-vehicles Insurance (Thirdparty Risks) Regulations, 1932, and the Second Schedule thereto, as if those regulations had not been revoked. 6. If any motor-vehicle (other than a motor-cycle or a motorvehicle used exclusively as a mourning-coach) belongs to Class Ba, Bb, Bc, Bd, or to Class 9, of the classes specified in the Second Schedule to these regulations, and also belongs to any other of those classes, the premium payable in respect of that vehicle shall be the premium prescribed in respect of Class Ba, Bb, Bc, Bd, or of Class 9, as the case may be. 7. Where the premium payable in respect of any motorvehicle is fixed by reference to its seating-accommodation the following rule shall be applied to determine the number of seats in any case where a division between individual seats is not clearly marked, namely : Every complete 16 in. of the length of an undivided seat shall be deemed to be a separate seat, and a length of seatingspace less than 16 in. shall not be deemed to be a seat. 8. Where, pursuant to section 15 of the Motor-vehicles Act, 1924, the registration of any motor-vehicle is cancelled on the ground that the vehicle has been destroyed, or has become permanently useless as a motor-vehicle, or has been permanently removed from New Zealand, and at the time of such cancellation there is in force in respect of the motorvehicle a contract of insurance under the said Act, the insurance company with which such contract of insurance has been effected shall, on application in writing made by the owner of the motor-vehicle, and on being satisfied that the registration of the motor-vehicle has been cancelled as aforesaid, refund to the owner a sum equal to one-twelfth part of the prescribed premium for every complete month between the date of the happening of the event which led to the cancellation of registration and the end of the term of the contract of insurance. 9. From every preihium paid in respect of any contract of insurance under the said Act the sum of 6d. shall be deducted for administration expenses in accordance with the provisions of subsection (2) of section 15 thereof.

PART 11. Interpretation of Terms used in Part I of this Schedule. In the interpretation of Part I of this Schedule (i) “ Private motor-car ” means any motor-car (as defined in the Motor-vehicles Act, 1924) not being a public motor-vehicle or a contract motor-vehicle (as hereinafter defined). (ii) Every term used therein (except the term “ private motor-car ”) which is defined in section 2 of the Motorvehicles Act, 1924, has the meaning assigned thereto by that Act.

(iii) The following terms, not defined in the vehicles Act, 1924, have the meanings herein assigned to them, namely : “ Public motor-vehicle ” means a motor-vehicle used for the carriage of persons for hire or reward (including a rental car), but does not include a motor-cycle or a contract motor-vehicle as hereinafter defined : “ Contract motor-vehicle ” means a motor-vehicle used for the carriage for hire or reward of school-children going to or returning from school either with or without teachers or other escorts, or used for the carriage for hire or reward of particular individuals (including clubs or parties of individuals), but never used or available for the carriage for hire or reward of the general public : “ Registration Plate Regulations ” means the regulations relating to registration plates made under the Motor-vehicles Act, 1924, on the 25th day of May, 1932, and published in the Gazette on the 27th day of the same month at page 1391 : “ Rental car ” means a motor-car let on hire to any person who himself drives or provides a driver, but does not include a passenger - service vehicle as defined in the Transport Licensing Act, 1931, and does not include a vehicle let under a hire-purchase agreement but not let on any further contract of hire: “ Private hire car ” means a public motor-vehicle which is not a passenger-service vehicle as defined in the Transport Licensing Act, 1931, and is not a public motor-car as defined in the Motor-vehicles Amendment Act, 1927 : “ Tractor ” means a vehicle or locomotive of the class of' locomotive propelled by mechanical power and known as the tractor if exclusively used otherwise than as a vehicle for the carriage of passengers (other than the driver) or goods. Regulations relating to Registration-plates under the Motorvehicles Act, 1924. (See New Zealand Gazette, 1933, page 1367.) BLEDISLOE, Governor-General. ORDER IN COUNCIL. At the Government Buildings at Wellington, this 15th day of May, 1933. Present: Right Hon. J. G. Coates presiding in Council. IN pursuance and exercise of the powers conferred on him by section thirty-six of the Motor-vehicles Act, 1924 (hereinafter referred to as “ the said Act and of all other powers enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations in amendment of the regulations (hereinafter referred to as “ the said regulations ”) under the Motor-vehicles Act, 1924, dated the twelfth day of December, one thousand nine hundred and twenty-four, and published in the New Zealand Gazette on the same day, at page 2943, and doth hereby revoke the amendment to the said regulations, dated the twentieth day of April, one thousand nine hundred and thirty-one, and published in the New Zealand Gazette on the twenty-third day of the same month, at page 1045.

REGULATIONS. 1. These regulations shall be read together with and form part of the said regulations. 2. For the licensing year commencing on the Ist day of June, 1933, all registration-plates referred to in the said regulations issued under section 6 of the Motor-vehicles Amendment Act, 1927, shall be metal plates which, for vehicles other than motor-cycles, shall be approximately 13|- in. long and 4| in. high, and for motor-cycles shall be approximately 7J in. long and 4-J- in. high. 3. The distinguishing-marks to be exhibited on the said registration-plates shall be as follows : (a) For private motor-cars and motor-cycles, as defined by the said Act, other than caravans (as defined in Regulation 5 hereof) and other than private motorcars or motor-cycles for which any other distinguishing marks are prescribed by these regulations, a series of numerals not exceeding five, either alone or preceded by the letter X. ( b ) In the case of plates issued to manufacturers and dealers in motor-vehicles in terms of section 18 of the said Act, a series of numerals preceded by the letter D. (c) For motor-vehicles exempt from license fees in terms of section 11 of the said Act (other than motor-cycles and motor-vehicles the property of the Crown), a series of numerals preceded by the letter E. (d) For motor-vehicles the property of the Crown (other than motor-cycles, or unless permission to the contrary is obtained from the Minister of Transport), a series of numerals preceded by the letters GOVT.

(e) For motor-vehicles which at the time when the application for a license is made are passenger-service vehicles within the meaning of the Transport Licensing Act, 1931, (i) If the body of the vehicle is designed for the carriage of both seated and standing passengers, a series of numerals preceded by the letter P. (ii) If the body of the vehicle is not designed for the carriage of standing passengers, a series of numerals preceded bv the letter S. (/) For motor-vehicles which at the time when the application for a license is made are rental cars or privatehire cars as defined in the vehicles Insurance (Third-party Risks) Regulations, 1933, a series of numerals preceded by the letter R. (g) For motor-vehicles (other than rental cars and privatehire cars, as defined in the last preceding paragraph) which at the time when the application for a license is made are vehicles described by paragraphs (a), (6), and (c), inclusive of the definition of “ passengerservice vehicle ” in section 2 of the Transport Licensing Act, 1931, a series of numerals preceded by the letter T. (h) For any motor-vehicle, the registration-plates for which are not prescribed by paragraphs (a), (6), (c), (d), (e), (/), and (g) of this regulation, and the gross weight of which unladen, together with the manufacturer’s rating of weight-carrying capacity, measures over 2 tons avoirdupois, a series of numerals preceded by the letter 11. (i) For any motor-vehicle the registration-plates for which are not prescribed by paragraphs (a), (b), (c), (d), (e), (/), and (g) of this regulation, and the gross weight of which unladen, together with the manufacturer’s rating of weight-carrying capacity, docs not measure over 2 tons avoirdupois, a series of numerals preceded by the letter L. 4. The said distinguishing marks shall be embossed and coloured white on a dark brown ground. 5. (1) If during the currency of a license a motor-vehicle is used for a purpose by reason of which if the vehicle had been so used at the time when the application for a license

was made a registration-plate differing from the plates actually issued would, pursuant to these regulations, have been issued, the owner may procure from a Deputy Registrar substituted registration - plates in such one of the forms described as may be appropriate. (2) If during the currency of a license and after the issue of substituted registration-plates pursuant to the lastpreceding clause of this regulation a motor-vehicle is used for a purpose by reason of which if the vehicle had been so used at the time when application was made for such substituted registration-plates a registration-plate differing from the plates actually issued, would, pursuant to these regulations, then have been issued, the owner may procure from a Deputy Registrar substituted registration-plates in such one of the forms described as may be appropriate. (3) If during the currency of a license a motor-vehicle is used for more than twenty-eight days for a purpose by reason of which if the vehicle had been so used at the time when the application for. a license was made, or (as the case may be), when application was last made for substituted registration-plates, a registration-plate differing from the plates actually issued would, pursuant to these regulations, have been issued, then it shall be obligatory upon the owner thereof, within seven days after the expiration of such period of twenty-eight days, unless within such seven days the use of the vehicle for such purpose as aforesaid has been discontinued, to procure substituted registration-plates in terms of this regulation. (4) No substituted plate shall be issued under this regulation until the owner has surrendered to the Deputy Registrar the plates previously issued for the current year, or on proof to the satisfaction of the Deputy Registrar that such plates have been lost or destroyed. (5) No fee shall be payable on the issue of any substituted plates under this regulation. (6) For the purposes of these regulations “ caravan ” means a motor-vehicle (including a trailer) designed principally to serve as a human abode. F. D.
