Circular No. 1933/2.] Memorandum for Permanent Heads

Payments of Superannuation Contributions on Total Emoluments.

1. Section 29 of the Finance Act, 1925, now section 115, Public Service Superannuation Act, 1927, provides, inter alia, that a contributor to the fund who, before the Ist day of October, 1925, was supplied in respect of his office with board and lodging or with the use of a house, or is paid an allowance in lieu of board and lodging or the use of a house, such emolument shall be deemed to form part of the salary received by such contributor, if, on or before the 31st day of March, 1927, a notice in writing electing to take advantage of this privilege is addressed to the Secretary, Public Service Superannuation Board, Wellington, and forwarded through the Department to which such contributor is attached. Those contributors to the fund who were entitled to elect as aforesaid, and who did not tender an election are now given, by virtue of section 26 of the Finance Act, 1932—33 (2), a further opportunity to so elect before the 10th day of September, 1933. 2. The annual value of the above emoluments shall be the amount stated in any Classification List or in any Act or regulations for the time being in force, or if not so stated such value shall be determined by a Committee appointed under the Superannuation Act. A lodging allowance paid to any officer by reason of his being stationed away from his home is not included in the above category.

3. Arrears of contributions on the amount added to salary must be paid at the rate now payable by the contributor as from the Ist day of January, 1908, or from the date when the allowance or benefit was granted if subsequent to the latter date, together with compound interest at the rate of 5 per cent, per annum computed yearly. Payment of arrears and interest may be made by instalments of such amount, and at such intervals as the Superannuation Board may direct.

4. You are requested to bring the contents of this circular to the notice of those officers of your Department who have been contributors to the Superannuation Fund as from a date prior to the Ist October, 1925, and are in receipt of emoluments as set out above, but have not hitherto tendered an election.

National Expenditure Adjustment Act, 1932.

1. Election to Contribute on Higher Rate of Salary

The time within which an election pursuant to section 9(1) of the above-described Act could be made has, by section 24 of the Finance Act, 1932-33 (No. 2), been extended to the 31st day of May, 1933.

Section 9 (1), as amended, now provides that where a contributor’s rate of salary is reduced by this Act he may, by notice in writing to the secretary of the Board, given on or before the 31st day of May, 1933, elect to continue to contribute to the fund as if his salary had not been so reduced, and every person so electing and contributing shall be entitled on retirement to a retiring-allowance (if any) of the same amount as that to which he would have been entitled if his salary had not been reduced by this Act.

The section also provides that, in the case of any contributor who, at the 31st day of March, 1932, is, pursuant to an election made by him under section 8 of the Finance Act, 1931, contributing to the fund on the basis of a higher rate of salary than that actually being received by him on that date, such person may elect, pursuant to this section, to continue to contribute to the fund on the basis of such higher rate, or to contribute on the basis of his salary as at the 31st day of March, 1932, and on his retirement his retiringallowance (if any) shall be calculated accordingly.

Illustration : “X ” on the 31st December, 1921, was in receipt of £320 per annum. He elected under the provisions of the Public Expenditure Adjustment Act, 1921-22, to continue to contribute on this amount. On Ist April, 1931, his actual salary— i.e., £295 per annum, was reduced to £265 10s. per annum, and under the provisions of the Finance Act, 1931, he again elected to continue to contribute on £320 per annum. His actual salary has been reduced to £238 19s. per annum as from the Ist April, 1932. He can elect either (1) to continue to contribute on £320 per annum ; or (2) to contribute on £265 10s. per annum ; or (3) he can notify the Superannuation Office that he does not intend to exercise his right of election under the National Expenditure Adjustment Act, 1932.

Contributors who did not elect on or before the 30th day of September, 1932, to contribute to the fund in accordance with this section, and who now desire to so elect should address an application to the Secretary, Public Service Superannuation Board, Wellington. It is desirable that the applicant’s full name and department be written clearly. The applications must, not be sent direct to the Secretary, Public Service Superannuation Board, but must be forwarded through the Permanent Head of the department to which the contributor belongs. Staff-clerks should note the election on the applicant’s personal file and salary record before forwarding the papers to the Superannuation Office. With regard to the arrears of contributions, departments will be advised of the amount due by contributors, and the period of time allowed by the Superannuation Office for the recovery of such amount from the individual’s salary.

(Note. The Superannuation Office has already been asked whether a contributor who had not tendered an election under the provisions of section 8 of the Finance Act, 1931, can now elect to contribute to the fund on the basis of the salary actually received by him on the 31st day of March, 1931. The answer to this question is in the negative.)

2. Contributors Retired since the 31st March, 1932

The Public Service Superannuation Office will communicate with those officers who have retired from the Service, and who have not on or before the 30th day of September, 1932, elected in accordance with the provisions of the section hereinbefore mentioned.

3. Contributors on Leave of Absence (Special or Sick).

You are requested to communicate the contents of this circular to officers on leave of absence who have not tendered an election in accordance with the provisions of the foregoing section.

4. Contents of Memorandum to be brought to the Notice of Contributors. Departments are requested to bring the contents of this memorandum to the notice of all contributors who have not hitherto made an election under the provisions of section 9(1) of the National Expenditure Adjustment Act, 1932. A limited number of copies of this circular is available for distribution.
