Censorship of Cinematograph films. With reference to the regulations under the Cinemato" graph-film Censorship Act, 1916, published in Police Gazette > 1916, pages 664-666, the Crown Law Office advises that clause 12 of the regulations, which requires that a copy of the Censor’s certificate of approval be screened with each film, is ultra vires. It is therefore nor, an offence to exhibit a censored film without the Censor’s certificate attached. When a film is exhibited without such certificate, the proprietor should be asked to produce the Censor’s certificate of approval, and, if he is unable to do so, inquiry should be made by telegraph from the Under-Secretarv, Internal Affairs Department, whether the film has been censored. If it has not been censored, then proceedings should be taken for an offence against section 7 of the Act. In any such prosecution it may be anticipated that the accused will admit that the film had not been censored, for if he refused to make such admission the only result would be an adjournment of the case in order to obtain the evidence of the Censor, and the heavy costs so incurred would fall upon the accused.
