Rex v. Dunn. (“ N.Z. Law Reports,” Yol. xxix, page 538.) Criminal Law —“ The Crimes Act, 1908,” Section 407 (1), (2) —“ The Justices of the Peace Act, 1908,” Section 154 —lndictment not 'preferred by Prosecutor Motion to quash. Where Justices, under section 154 of “ The Justices of the Peace Act, 1908,” bound over a person to prosecute the accused at the following criminal sittings of the Supreme Court, that person, not being a person who had laid the information on which the warrant for the arrest of the accused was issued,— Held, That by virtue of section 407, subsection 1, of “ The Crimes Act, 1908,” the person so bound over could prefer the bill of indictment to the grand jury. Motion to quash an indictment. The facts are sufficiently stated in the judgment. Section 154 of “The Justices of the Peace Act, 1908,” is as follows: “The Justices before whom any such witness is examined as aforesaid, or any other Justice, may bind by recognizance (12 App. Cas. 29) the prosecutor and every such witness to appear at the Court at which the accused is to be tried, then and there to prosecute and give evidence, or to give evidence, as the case may be, on the trial of the accused party.” Subsections 1 and 2 of section 407 of “The Crimes Act, 1908,” are as follows : “ Any one who is bound over to prosecute any person, whether committed for trial or not, may prefer a bill of indictment before the grand jury for the charge on which the accused was committed, or in respect of which the accused is so bound over, or for any charge founded on the facts or evidence disclosed in the depositions taken before the Justice. 2. The Attorney-General, or any one with the written consent of a Judge of the Supreme Court or of the Attorney-General, may prefer a bill of indictment for any offence before the grand jury of any Court specified in such consent; and any person may, by order of the Supreme Court, prefer any bill of indictment before that Court at a sitting for the trial of criminal cases.” Cooper in support of the motion. 0. A. Loughnan to oppose. Cur adv. vult. Chapman, J. : Mr. Cooper moved to quash the indictment on the ground that the bill of indictment had not been preferred to the grand jury by ths prosecutor or any other of the persons described in section 407 of “ The Crimes Act, 1908.” The suggestion is that the person bound over to prosecute must be the prosecutor referred to in section 154 of “ The Justices of the Peace Act, 1908.” Here it was Detective Quirke who preferred the bill of indictment, he having been bound over to prosecute. He had not, however, laid the information on which the warrant for the arrest of the accused was issued in 1903, nor had he since Mid an information against him. I think that the section must be read literally, and that it means that any person who undertakes the prosecution and submits to be bound over may prefer a bill of indictment. Mr. Cooper asked me to reserve the question for the Court of Appeal. This I refuse to do. I have, however, taken a note of his application in compliance with section 442, subsection 3, of “ The Crimes Act, 1908.” Solicitors for the accused : Bell, Gully, & Cooper (Palmerston North).
