(From Gazette, 1901, pages 947, 950, 985, 986, 987, and 990.) Extending the Close Season for Seals. RANFURLY, Governor. ORDER IN COUNCIL. At the Government Buildings, at Wellington, this nineteenth day of April, 1901. Present: The Right Honourable R. J. Seddon presiding in Council. WHEREAS by “ The Sea-fisheries Act, 1894 ” (hereinafter termed “ the said Act ”), it is, among other things, enacted that the Governor in Council may from time to time make regulations (which shall have general force and effect throughout the colony, or particular force and effect only in any waters and places specified therein) for prescribing, among other things, a close season for seals, and for extending any close season so prescribed:

And whereas it is further provided by the said Act that every person who, during any close season for seals, takes any seals is liable for every such offence to a penalty not exceeding five hundred pounds, and in addition thereto is liable to a further penalty, not exceeding twenty pounds, in respect of every seal so taken: And whereas by Order in Council, dated the twenty-first day of December, one thousand eight hundred and ninetyfour, the months of January, February, March, April, May, and June, one thousand eight hundred and ninety-five, were prescribed a close season for seals: And whereas by Order in Council, dated the twentyseventh day of March, one thousand nine hundred, the said close season for seals was extended up to the thirtieth day of June, one thousand nine hundred and one:

And whereas it is desirable to further extend such close season for seals :

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the regulations set forth in the Schedule hereto; and with the like advice and consent doth order that such regulations shall have force and effect throughout the Colony of New Zealand, and in all salt, fresh, and brackish waters of the colony, and on all shores of such waters or any part thereof.

SCHEDULE. Regulations. 1. The close season for seals prescribed by regulations made by Order in Council dated the 21st day of December, 1894, and published in the New Zealand Gazette No. 1, of the 4th day of January, 1895, and which was, by Order in Council dated the 27th day of March, 1900, extended up to the 30th day of June, 1901, is hereby further extended up to the 30th day of June, 1902. 2. Every person who, during the close season prescribed as aforesaid, takes any seal is liable to a penalty of not less than £25 nor more than £SOO, and in addition thereto is liable to a further penalty of not less than £1 nor more than £2O in respect of every seal so taken. The taking of seals means and includes the killing, catching, dredging for, raising, or hunting of any seal, or any attempt so to do. 3. No person shall buy, sell, expose for sale, consign for sale, buy for sale, or have in possession any seal, or any skins, oil, or blubber from any seal, in any manner in contravention of the said Act or of these regulations; and every person so doing is liable for every such offence to a penalty of not less than £1 nor more than £2O. RANFURLY, Governor. PURSUANT to the powers conferred upon him by “ The Animals Protection Act, 1880,” His Excellency the Governor of the Colony of New Zealand doth hereby notify that native and imported game shall not be taken or killed within that portion of the County of Eden, in the Auckland Land District, more particularly described in the Schedule hereto. SCHEDULE.

All that area in the Auckland Land District bounded towards the north-west generally by Green Lane from the Great South Road to St. John’s College and St. Hillier’s Bay Road; thence by that road to the road forming the eastern boundary of Allotment No. 37, Section No. 12, Suburbs of Auckland (Parish of Waitemata) : thence towards the east by the road forming the eastern boundaries of Allotments Nos. 37, 48, 47, 26a, 26, and 27 to the Auck-land-Panmure Road : and thence towards the south by the said Auckland-Panmure Road and the Great South Road to the place of commencement. As witness the hand of His Excellency the Governor, this thirtieth day of April, one thousand nine hundred and one. WM. HALL-JONES.

Notice respecting Native and Imported Game.

Colonial Secretary’s Office, Wellington, 24th April, 1901. THE attention of sportsmen, game-dealers, and others is called to the provisions of “ The Animals Protection Act Amendment Act, 1889,” “ The Animals Protection Act Amendment Act, 1895,” and “ The Animals Protection Acts Amendment Act, 1900,” which are now in force. A digest of the chief of such provisions is subjoined, viz.:—

“ The Animals Protection Act Amendment Act, 1889.” Section 4. No person shall kill, destroy, or shoot at any game or native game with anything but a shoulder-gun, and no such gun must exceed size No. 10 at muzzle, or be fitted with barrels exceeding 86 in. in length. No gun shall exceed 10 lb. in weight. Any person offending against this provision is liable to a penalty not exceeding £lO. Section 5. No person shall sell any native game, or take or kill any native game for the purpose of sale, without previously taking out the required license. Penalty not exceeding £2O. Section 6. No sale of native game shall take place prior to the Ist May and subsequent to the Ist August in any year. If any person hold a license to sell game— i.e., imported game—he is not liable to pay a second fee on taking out a license to sell native game. But both licenses must be taken out if it is intended to sell both kinds of game.

“ The Animals Protection Act Amendment Act, 1895.” Section 6. Section 12 of “ The Animals Protection Act, 1880,” is repealed. No person can now sell game, or dispose thereof for any gain or reward, unless he be the holder of a license to sell such game. Penalty not exceeding £2O.

“ The Animals Protection Acts Amendment Act, 1900.” Section 2. Season for taking or killing native and imported game, Ist May to 81st July (except in Provincial District of Otago, where the season is Ist April to 30th June). Section 3. No game or native game to be exported without the written consent of the Colonial Secretary, nor held in possession for a greater period than seven days after close of season, whether such game or native game be frozen, chilled, or not.
