Amended Regulation for Trout-, Perch-, and Tench-fishing, Southern Acclimatisation District, Ashley River.

RANFURLY, Governor. ORDER IN COUNCIL. At Christchurch, this first day of November, 1900.

Present: His Excellency the Governor in Council.

WHEREAS by an Order in Council dated the seventh day of September, one thousand eight hundred and ninety-two, and published in the New Zealand Gazette of the eighth day of September then instant, certain regulations were made under “ The Fisheries Conservation Act, 1884 ”

(hereinafter termed “the said Act”), providing for trout-, perch , and tench-fishing within the Southern Acclimatisation District as therein defined :

And whereas it is expedient to amend Regulation No. 13 of the said regulations in manner hereinafter mentioned : Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of the powers conferred by the said Act and of all other powers enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order as follows:—

Regulation No. 13 of the regulations made under “ The Fisheries Conservation Act, 1884,” dated the seventh day of September, one thousand eight hundred and ninetytwo, is hereby amended by adding thereto the following words: “ Provided that nothing herein contained shall prevent the placing of any net other than a stake-net in or across the mouth or entrance of the following river—viz., the Ashley River—or at any place in such river seaward of a straight line drawn from the southernmost corner of Rural Section No. 716, Rangiora Survey District, on the northern bank of the said Ashley River, thence through the south-easternmost corner of Rural Section No. 23889, Rangiora Survey District, to a point on the southern bank of the said Ashley River, for the purpose of taking indigenous fish only, nor render any person liable to any penalty for so doing, or for taking indigenous fish by such means.” W. Animals Protection Acts.—Declaring Reserve for Native and Imported Game, Hawksbury Domain, Waikouaiti County.

RANFURLY, Governor

PURSUANT to the powers conferred upon him by “ The Animals Protection Act, 1880,” His Excellency the Governor of the Colony of New Zealand doth hereby notify that native and imported game shall not be taken or killed within that portion of the County of Waikouaiti, in the Otago Land District, more particularly described in the Schedule hereto.

SCHEDULE. All that parcel of land in the Otago Land District, containing by admeasurement (excluding the exemptions therefrom) 155 acres 2 roods, more or less, situate in the Town of Hawksbury, and being that portion of said town lying towards the east of Kirkwall and Wick Streets. Bounded towards the north by the northern boundary of said township, also by Cemetery Reserve; towards the east by the eastern boundary of said township and Cemetery Reserve; towards the south by part of the unsurveyed portion of said town and the southern boundaries of Sections 1,4, 5,6, 7, 8,9, and 12 of Block LXXI.; towards the west by Kirkwall and Wick Streets, also by Cemetery Reserve : which area is exclusive of the following sections and portions of streetlines—viz., Sections 10 and 11, Block XVIII.; Section 1, Block XXVII.; Section 4, Block XLIII. ; Sections 1 to 22, Block XLVIII.; Sections Ito 5, Block XLIX.; Sections 17 to 21, Block LVI.; and Section 1, Block LXI.: also the following portions of street-lines —viz., parts of Banff Street, Aberdeen Street, cross street between Aberdeen and Banff Streets, Cupar Street, Kinross Street, Inverary Street, Rotlisay Street, Dumbarton Street, Linlithgow Street, Leith Street, Waddington Street, Greenlaw Street, and Dornoch Street.

All that parcel of land in the Otago Land District, containing by admeasurement 100 acres, more or less, situate in the Town of Hawksbury. Bounded towards the north-west by Crown lands, 150 links; towards the north by Sections 2, 3, and 4 of Block LXVIII., 300 links; towards the east by Section 7 of same block, 50 links; towards the north by said section, by Inverness Street, and by Section 1 of Block LXIX., 600 links; towards the west by Section 1 of said block, 50 links; towards the north by Sections 4,5, 6,7, 8, and 9 of Block LXIX., 600 links; towards the east by Section 12 of said block, 50 links; towards the north by said section, 250 links, also by Section 1 of Block LXX., 250 links; towards the west by said section, 50 links; towards the north by Sections 4,5, 6,7, 8, and 9 of Block LXX., 600 links; towards the east by Section 12 of same block, 50 links; towards the north by same section, by Kirkwall Street, and Section 1 of Block LXXI., 600 links; towards the west by same section, 50 links; towards the north by Sections 4,5, 6, 1, 8, and 9 of Block LXXI., 600 links; towards the east by Section 12 of same block, 50 links ; towards the north by said section, by Dornoch Street, also by Commonage Reserve, 966 links; towards the east by Section 6 of Block VI., Hawksbury District, 1000 links ;

towards the south-east by Section 19 of said block, 2300 links ; and towards the south-west by a lagoon, 6600 links : be all the aforesaid linkages more or less : and intersected by Edinburgh Street, 150 links. PURSUANT to the powers conferred upon him by “ The Animals Protection Act, 1880,” His Excellency the Governor of the Colony of New Zealand both hereby notify that native and imported game shall not be taken or killed within that portion of the Mandeville and Rangiora Road District, in the Canterbury Land District, more particularly described in the Schedule hereto. SCHEDULE. At.t. that area in the Canterbury Land District, being Reserve No. 807, containing by admeasurement 288 acres, more or less, situated in Block XII., Rangiora Survey Dis trict. Bounded towards the north by Gladstone Road, Rural Section No. 34845, and the southern boundary-line of that section produced to a road reserve along the sea-shore; thence towards the east by the said road reserve along the sea-shore to a point in line with the northern boundary-line of Rural Section No. 13659; thence towards the south by a right line to the north-eastern corner of the said Rural Section No. 13659, thence by Rural Sections Nos. 13659, 10929, 15734, 10695, and Reserve No. 2134; and towards the west by Rural Section No. 4539. As witness the hand of His Excellency the Governor, this first day of November, one thousand nine hundred.

Regulations for netting Trout in Lakes Te Anau and Manapouri. RANFURLY, Governor. ORDER IN COUNCIL. At the Government Buildings, at Wellington, this sixth day of November, 1900. Present: The Honourable W. Hall-Jones presiding in Council.

IN pursuance and exercise of the powers and authorities vested in him by “ The Fisheries Conservation Act, 1884,” His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations for netting trout in Lakes Te Anau and Manapouri, within the Southland Acclimatisation District ; and doth hereby declare that these regulations shall, as from the date of the publication hereof in the New Zealand Gazette, supersede all regulations at variance therewith : Regulations. 1. For the purpose of supplying hotels, accommodationand boarding-houses, and residents within a limit of twenty miles of Lakes Te Anau and Manapouri, within the district of the Southland Acclimatisation Society, the secretary of such society is hereby empowered, but shall not be compelled, to issue under his hand a license to use a net or nets for taking trout in such lakes, or either of them, to any person resident thereat respectively; and for every such license a fee of not exceeding two pounds may be charged for each net specified in such license; and such secretary is hereby authorised to limit the holder of such license to one or more net or nets only. 2. For the above purpose the said lakes, or either of them, may be divided into such areas as such secretary may con-

sider advisable, and every license may describe the limits within which the same is to be used and the number of nets to be employed, or may describe that the same is available for use anywhere in such lakes respectively. 3. The season for netting shall extend from the first day of October in any year to the thirtieth day of April in the following year, both days inclusive.

4. No net with a mesh of less than four inches and a half shall be used, and stake or fixed nets and seine nets for hauling are hereby expressly prohibited. All trout caught by net under three pounds in weight shall be forthwith returned alive to the water.

5. No nets for the taking of trout shall be used in any of the rivers, streams, or creeks communicating with the said lakes respectively, excepting the Clinton River for one mile distant from its mouth.

6. No salmon, salmon-parr, or smolts shall be taken in any net, and if so taken by accident or otherwise shall be forthwith returned alive to the water.

7. Any person holding a trout-fishing license under the provisions of the existing trout-fishing regulations may fish with rod and line in the said lakes, rivers, or streams respectively, anything contained in these regulations notwithstanding. 8. The Southland Acclimatisation Society, through their officers, rangers, constables, or any other person duly authorised, shall have full power at any time to inspect, examine, and search for any nets, tackle, engines, boats, or any utensils or instruments, which, in the opinion of such authorised person, are or have been used or employed for the taking of fish within the said lakes respectively, or the rivers and streams communicating therewith, and to seize and appropriate in the interests of the said society all and every such nets, tackle, engines, or any utensils or instruments so used or employed, and also to seize and appropriate as aforesaid all and every fish caught and in possession of any person during the close season, or in possession of g,ny person who cannot or does not produce, at the time of catching or disposing of such fish, a license under the hand of the secretary aforesaid empowering him in that behalf. 9. The moneys realised by the issue of such netting licenses as aforesaid shall form part of the revenues of the said society, and be accounted for accordingly. 10. Any person offending against any of these regulations shall be liable to a penalty of not less than one pound and not exceeding fifty pounds, and any licensee convicted of so offending shall upon conviction ipso facto forfeit his license, and the Court by which such penalty is inflicted may declare that any nets, gear, or tackle used in connection with the commission of such offence are also forfeited to the said society, and may be disposed of as it thinks fit.
