Normanby, Governor. ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of January, 1879.

Present: His Excellency the Governor in Council.

Whereas by “The Supreme Court Act, 1860,” it is enacted that there shall be held Circuit Courts for the despatch of Civil and Criminal business of the Court before one of the Judges thereof, at such places and times as the Governor in Council may from time to time appoint: Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, in pursuance and exercise of the power and authority vested in him by “ The Supreme Court Act, 1860,” doth hereby appoint that there shall be held in the Nelson District, at the Provincial Council Hall at Nelson, on Tuesday, the first day of April next, and in the Westland District, at the Supreme Courthouse at Hokitika, on Tuesday, the eighteenth day of March next, Circuit Courts for the despatch of Civil and Criminal business of the. said Court. Additional Regulations under “ The Salmon and Trout

Act, 1867.”

Normanby, Governor.

Whereas under the authority of “The Salmon and Trout Act, 1867 ” (hereinafter termed the said Act ”), certain regulations were made for the purposes of the said Act, and published in the New Zealand Gazette of the thirteenth day of September, one thousand eight hundred and seventy-seven, and such regulations are now in force : And whereas by the said Act it is, among other things,

enacted that it shall be lawful for the Governor, from time to time as may become necessary, to make such regulations as to the Governor seems expedient, for imposing or prescribing any conditions and restrictions in respect to salmon or trout fishing : And whereas, for the purpose of protecting salmon and trout, it is expedient that additional regulations should be made as hereinafter provided : Now, therefore, I, George Augustus Constantine, Marquis of Normanby, the Governor of the Colony of New Zealand, in pursuance and exercise of the hereinbefore recited power and authority, and of every other power and authority enabling me in that behalf under the said Act, do hereby make the following regulations, that is to say, —•

1. If any person shall by any means take or catch any salmon or trout in any stream, river, or tidal water, lie shall forthwith return such salmon or trout alive to the stream, river, or tidal water in or from which the same was caught or taken. Any person knowingly and wilfully committing a breach of this regulation shall be liable to forfeit and pay such sum of money, by way. of penalty, not exceeding one hundred pounds, as the Justices imposing such penalty shall think fit. The expression “tidal waters” has the like meaning as given to such expression in certain regulations made under “The Fish Protection Act, 1877,” and published in the Neiv Zealand Gazette of the eleventh of April, one thousand eight hundred and seventy-eight. 2. No person holding a license issued under the said lastmentioned regulations shall bo deemed exempt from these or any other regulations in force under “ The Salmon and Trout Act, 1867.”

3. These regulations shall be read as part of any existing regulations for the time being in force under the said Act, and, whenever any penalty shall be prescribed under any regulations in force under the said Act as aforesaid, it shall be lawful for the Justices imposing the same to order such part of the prescribed penalty to be paid as the Justices before whom the same shall be sought to be recovered shall think fit.
