A case of some importance to cycle dealers was beard at the Christchurch Magistrate’s Court on April 4 Mr Beetham delivered judgment in the case of E. W. Pidgeon and Co. (Mr Cassidy) v. A. M‘Kay (Mr Izard) This was a case which had occupied the Court several sittings. The facts are these: In July, 1899, Messrs Nind-Ward and Co., the sole New Zealand agents of the Envoy bicycle, gave possession of an Envoy bicycle under hiring agreement to one Rose, of Geraldine. Under this agreement Rose could retain the machine so long as he paid the several instalments of hire, on the terms that the hirer might terminate the hiring by delivering up the bicycle to the owners, he remaining liable for all arrears of hire. Also that if the hirer should pay punctually all the monthly instalments the bicycle should become his absolute property, and that until such full payment the bicycle should remain the sole property of the owners. Rose received the bicycle, paid & ti umber of instalments, and then went to the North Island. The bicycle was next discovered in possession of the defendant, M‘Kay, who asserted he had bought it from Rose and paid for it; and M‘Kay refused to return it. The action was brought by E. W. Pidgeon and Co., Ltd., purchasers of the business of NindWard and Co., against M'Kay. It was contended for the plaintiffs that M‘Kay had obtained no right or title to the machine, such being still the property of the plaintiffs or their predecessors. The Magistrate now gave judgment to the effect that it was clear that the property of the bicycle remained in the plaintiffs. The defendant’s remedy was against the person who sold him the bicycle. He ordered the defendant to return to the plaintiffs forthwith the bicycle, which he valued at £lO, and to pay £1 damages. The defendant was also to pay costs.
