SEPARATION ORDER
APPLICATION GRANTED The fact that a maintenance order had been issued in 1941 but the parties had later resumed co-habita-tion, two more children having been bom since, was revealed in a case in the Magistrate’s Court, Hamilton, yesterday, in which Mary Jane Moody applied for a separation order against John Leonard Moody. Mr N. I. Smith, appearing for plaintiff, said that there were now four children, all under the age of seven. Defendant had made no recent payments of maintenance. Defendant, who was represented by Mr K. L. Sandford, alleged misconduct between his wife and another man. The magistrate, Mr S. L. Paterson, said he was not prepared to accept this evidence. Mr Paterson said plaintiff had given instances of actual ill-treatment at the hands of her husband. He granted a separation order, an order for the guardianship of the children and maintenance at the rate of £1 a week for plaintiff and 10s for each of the four children.
