BANKRUPTS DISCHARGED.

ONE APPLICATION OPPOBED. WAHAROA FARMER’S FAILURE. Opposition by two creditors was made in the Supreme Court at Hamilton to-day when Daniel Gill, a sharemilker, of Waharoa, applied for his discharge as a bankrupt.

The applicant, in the witness box, outlined the history of liis business transactions and the failure of his farm. He bought 102 acres in 1911) from a Mr Ford at Waharoa at £36 an acre with a deposit of £2OO, lie said. The venture did not succeed and witness’ wife was offered a property rent free. She worked the place while he went out to work, although he gave his wife some assistance.

In 1932, applicant stated, his wife’s venture failed and her solicitors took over her affairs. During this time applicant had to maintain seven children.

Cross-examined by Mr Newbury, counsel for one creditor, applicant admitted that for 2 years prior to his petition in bankruptcy being filed he was sharemllklng and the farm was no responsibility to 'him. His Honour held that taking the whole of the circumstances the evidence. did not show that defendant, had been guilty of a breach of moral or legal duty. Ho had been burdened ! with tiie upkeep of a large family during the depression when the dairy farmer had difficulty in making ends meet. The application for 'a discharge would therefore be granted.
