Commonwealth. Attorney—General‘ has sent (1 radio message! to the Associated Press from the liner Strnthaird, en route to Aus—tralia. saying it was impossible for him to comment on the Privy Council decision upholding the appeal of F. A. James until he had seen the complete Judgment. it seemed clear. however. that. the dried fruits, dairy products, and wheat schemes would all become invalid. and organised marketing schemes on a compulsory basis must either be abandoned or a constitutlonal amendment at once at—tempted. TRADE WITH DOMINION. POSITION REMAINS UNCIiANGED. EXPORTS NOT AFFECTED. (By Telegraph—Press Association.) WELLINGTON. Monday. The Australian Trade Commissioner in New Zeal-and, Mr R. 11. Neshi‘tt. stated to-tlny that the decision of the Privy Council as disclosed in the press of the Dominion on Saturday affects the sales of dried fruit within the borders of the Commonwealth itself and does not affect dried fruit exports from Australia. This is of interest to buyers of dried fruit in New Zealand. as s misunderstanding might be created. The acting-chairman or the Commonwealth Dried Fruit Export Control Board made the following statement to the Australian press: ”The James Judgment did not affect the activities of the Export Control Board. which was set up under the Commonwealth legislation. dealing solely with the export of fruit from Australia. The case before the Privy Council dealt with the fruit law of the Commonwealth. which was complementary to the dried fruit acts of several States of Aus—tralia. and the effort at" all of which was to regulate trade. within the Contmonwealth. The decision of the Privy Hounril therefore dill not affect the successful operation of the Export control Act. “It will he noted from the foregoing that as far as the Commonwealth trade \\ith New Zealand in dried fruits is concerned the position ‘remains unchanged,‘ ‘he added. m
