UNDEFENDED PETITIONS.

BUSY MORNINIG IN COURT.

VARIETY OF GROUNDS. Mr Justice Callan was occupied for about 2} hours in the Supreme Court, Hamilton, this morning in dealing with a large number of undefended petitions for divorce. Basing bis petition on the events which allegedly took place in a shop in Hamilton on April 14 last, Peter George Conly applied for a dissolution of his marriage with Margaret Miller Conly. Mr E. McGregor, for petitioner, stated that a claim for damages against the co-respondent had been abandoned.

In evidence, petitioner said the parties were married in June, 1923, and there were four children. On January 17, 1935, his wife left their home in Morrinsville and he subsequently discovered that she was living with a man named Thomas Russell in Hamilton. On April 4 petitioner watched a shop in which his wife and Russell spent the night alone.

Edward John Stevenson gave evidence that the respondent and corespondent occupied a room in his house as man and wife for some time. A decree nisi was granted with costs against the co-respondent.

“Virtue Not Triumphant.”

When Leslie Lord proceeded against Essie Muriel. Lord for a divorce petitioner gave evidence that the parties were married in March, 1927. In 1932 he heard that his wife had become friendly with a warder at the Hautu Prison Camp. On Anzac Day, 1932, petitioner and the warder were involved in a fight in which he (petitioner) came off second best. Mr Strang (for petitioner) : This is one of the cases in which virtue was not triumphant. Petitioner said he and his wife then verbally agreed to separate. A decree nisi was granted. Convicted of Bigamy. Bigamy and adultery were the grounds upon which Ruby Nina Carlsen took action for divorce against her husband Cecil Sven Carlsen. Petitioner said she and Carlsen were married in April, 1927, and they lived at Auckland and Ohura. There was one child. In February, 1935, the husband left home and failed to return. Last April he was charged with' bigamy at Hamilton. He pleaded guilty and was admitted to probation. A decree nisi was granted. Husband’s Drinking Habits. Frances Jubilee May Smith sought a severance of her alliance with Joseph Smith. Petitioner said she married respondent in October, 1921, and there was one child. Disputes arose over respondent’s drinking habits and they agreed in October, 1924, to separate. They had remained apart since.

His Honour granted a decree nisi. Grounds of Misconduct. Phillip Ernest Reddaway, on the grounds of his wife’s misconduct, sought a decree nisi against Hannah Violet Reddaway. Angus McKinnon was cited as co-respondent. In evidence petitioner said they were married in February, 1920. McKinnon became friendly with them at Arapuni and in March, 1935, she left home ostensibly to visit her morher. Petitioner then received word that his wife was living with McKinnon. He ultimately located her at Thames and she refused to return. A decree nisi was granted, . Verbal and Written Agreement. Ada Lena Jelavich, in seeking a divorce from Peter Jelavich, stated in evidence that she married respondent in February, 1923, and there were two children. In July, 1932, Hiey entered into a verbal agreement to separate which-was confirmed by a written agreement a year later.—A decree nisi was granted. On the grounds of a mutual separation agreement, signed in July, 1932, Lucy Hudson was granted a decree nisi against her husband, Herbert Arthur Hudson. Ethel Mavis Sebley was granted a decree nisi again Norman Mark Schley. Evidence was given by petitioner that she married respondent in July 1927. There was one -child. Owing to her husband's failure to provide a decent home for her and owing to iiis drinking ham Is she left him in March. 1928. Efforts were made to induce him to provide a home without success. Failure to Return. The following were granted decrees nisi on the grounds of failure lo comply with decrees for restitution of conjugal rights: Harriet Eileen Eliza Basket! v. Robert Bremner Baskett; Johannes Christian Fredericksen v. Doris Ebrey Fredericksen; Frederick Charles Haycraft v. Marie Blianog Haycrafl. Arnold Ripley William Jacomb was granted a decree nisi against Maisie White Jacomb on Die grounds of desertion. Petitioner said the parties were married in June, 191-i, and there was one child. In August. 1027. at Wellington, his wife descried and had not returned. Alma Rachel Russo, in petitioning for a decree nisi from her husband Doniinico Richard Julio Russo, produced a separation agreement signed in July, 1032, in support of her petilion, which was granted.
