CAMBRIDGE TO AUCKLAND. AN APPEAL DISALLOWED. NOT SHOWN TO BE NEEDED. AUCKLAND, Monday. -The Transport Appeal Board on Saturday disallowed an appeal by D. G. Kelly, service-car proprietor against a decision by the Central Licensing Authority refusing to renew a licence for a passenger service between Cambridge and. Auckland. Appellant had conducted an ownerdriver service between Auckland and Cambridge and the Central Licensing Authority had refused to renew the licence. He asked that it be renewed in the terms which-had existed during the five years he had operated the service.

Counsel for appellant said the service was the only one which allowed reasonable comfort and celerity between Auckland and Cambridge. Only one car w r as operated, leaving Cambridge at 7 a.m. on week days and arriving at Auckland at 11-17 a.m. On week days the return trip commenced at 4 p.m. and Cambridge was reached at 8-17 p.m. On Saturdays the car left ■Auckland at 7.30 p.m., arriving at Cambridge at 11.47 p.m. No other service, either by car or rail, enabled Cambridge residents to visit Auckland on business and return in comfort on the same day. A petition supporting appellant’s application had hern signed by a large number of loading Cambridge residents. Counsel for the Railways Department said the service was in direct competition with the limited express between Frankton and Auckland and with the train leaving Frankton at 7.23 a-in. and arriving at Auckland at 10.45 a.m. The latter train was served by buses four days a week from Cambridge. There were adequate return services by train and bus.

His Honour said the service was not shown to toe a necessary passenger service, and the appeal was accordingly disallowed.
