COMPANIES' APPLICATION. DECLARATORY JUDGAIENT REFUSED WELLINGTON, Wednesday. In its reserved decision the Supremo Court declined to give a declaratory judgment in tlie matter of questions put by the Dairy Proprietary Association and the Waikato Dairy Co., Ltd., in regard to Hie powers of the Dairy Produce Control Board. In concluding the judgment the Chief Justice says: “Our decision places no real difficulty in plaintiffs’ way. They can obtain a decision of the Court upon any action contemplated by the board which they claim to contravene their rights in an uciion claiming a declaration of right an: .Or injunction. They cannot, howev. in such an action as the present obtain an opinion of the Court on tlie interpretation of substantially all provisions of the statute.
