EFFORT TO DETAIN SHIP
APPLICATION OF A SEAMAN. AN ORDER REFUSED. (By Telograph.—Press Assn.) AUCKLAND, Wednesday. At the Supreme Court, one of the crew of tho steamer Matakana, applied for an order restraining the captain from sailing from Auckland without him. His Honor, Mr. Justice Reed, said ho was not prepared to make an order compelling the master to take the man away. Whatever damage hat been suffered by the seaman could be recovered if he had any rights. One could not shut one’s eyes to facts, and he was not prepared, in the face of what was known to bo virtually mutiny, to detain a big British ship In such circumstances. The order would be refused. John Cain, the applicant, signed on as a trimmer In London for three years from July, 1925. He claimed £25 damages.
