MCDONALD V. CLEAVE. ' MOTION FOB NEW TRIAL. REFUSED BY JUDGE. By Telegraph;—Press Association. AUCKLAND, Friday. Mr Justice Herdman declined lo grant a new trial in the case for G. R. W. McDonald v. Arthur Cleave, on the alleged grounds that the damages were excessive, that new and material evidence had been obtained, that the verdict was obtained by unfair practice of plaintiff's counsel, and that the Judge misdirected the jury on material points of law.
