CLAIM AIMO COUNTERCLASIV].
MONEYS MORALLY DUE
Yesterday a case was heard in the Magistrate's Court, Hamilton, in which 11. Yv r . Sly, formerly of Te Rana, but now residing in Papatoctoe, farmer (Mi- J. !•'. Strang), claimed from W. R. Booth and Vincent Booth, farmers. Te Rapa, £l-i 17s for grazing, the debt b ling incurred in December, 1921. The defendants (Mr Rawson) admitted tne claim but counterclaimed the same sum from ihe plaintiff, alleging they loaned horses to Sly in exchange for the grazing.
Evidence on behalf of the defendants was given by Joshua Mathers and the Deputy Official Assignee (.Mr Sanson) who stated that Sly had'admitted that there was a. contra, against ids grazing account This was denied by Sly who said that the loan of the horses was in exchange for services given to Booths by his then employee. Mr Percy Wood
Examined by the Magistrate, Mr Booth admitted that tbe loan of Ihe horses \vas about equivalent in value lo 'Mr Wood's services. In giving judgment, dismissing the counter-claim will) costs, the Magistral e hold that if was quite clear from the evidence that morally Booths owe,l Sly the amount be bad claimed.
