Robebston Bhos.— Claim £2 4i% It. appeared from the evidence that the pnrties had had commercial * dealings. Plaintiff, who is a farmer in the Whatawhata district, had supplied the . defendants, grocers in Auckland, with butter. Some dispute as to quality and " price had arisen, and after an interview plaintiff accepted a certain sum of money, and gave a receipt in full. This defendants took to include the price of the kegs, but plaintiff objected, and hence the action for the value of the kegs. Evidence waa led to show that it was not customary to sell the kegs with the butter, and his Worship gave judgment for the amount claimed, failing i the return of the keep in good order and condition, with costs, £2 4s. A few other cases were on the sheet, but were either withdrawn, adjourned, or judgment was confessed.
