Civil Case. Frederick Davys v. Henry Hadfield.— Claim £18, value of a lioise belonging to plaintiff, destioyed by defendant.— Mr Gresham appeared for plaintiff. The parties are fauneis residing at Tuhikaramea. The hoibc in question was a source of great annoyance to defendant, trespassing on "his land, and bieaking his fences, and in a moment of exasperation he fired at it and killed it. Thereupon he acquainted the plaintiffs father of the fact, and the latter said he would claim excessive damages. Subsequently defendant offered either to give £10 for the" horse, or to allow two independent parties to purchase one as good in his name. To this plaintiff demurred, and after some fmther fruitless attempts to come to an arrangement, the present action was taken. A large amount of evideuce was taken to determine the value of the horse. Plaintiffs witnesses variously deposed that the animal was woiih from £10 to £20, while defendant's witnesses gave it as their opinion that the outside value of the horse was £10, and defendant himself valued it at from £4 to £G. Judgment was given for £10, each party to pay his own costs. A number of small debt cases were settled out of court.
