Alleged Assault. J. H. Thompson \. Pohli:n\ Aswuill and abusive language. J. H. Thompson, bwoin, stated : I ;un a settler residing at Harapepe. Ha\ c known defendant for yoais. On the 12th hist. I heaid Pohlen calling mo from over the fence. I looked up, and told him I did not w ant to bay anything, and to go away. He said I was a thief, <fee. ; I heard him mention nun dei 1 . His language was violent. He had a stick. 1 took hold of it, and u c botli fell in the ditch. He held nu> by the beard ; I was on the top. Toolc the stick fiom him, and told him to go away. I let him iise ; 1 was on the top. He made at me again. I only used my fists to keep him off. He went away abusing me as long as he was in sight. No one was present to .sco the assault, but there ;ue thobo piesent who heaid the abusive language. To plaintiff : You did not call out "Mr Thompson." I did not say " (lo away you blackguaid old scoundrel.'" I might have .said '" (/o away you old scoumliel.'' To the coiut . Tliis took place in the public load about 10 chains fiom niy house. [ .should not ha\ c gone out of my o\\ n paddock h.id he not oiled me. He flouiished Ins stick close to my face, oi I should not have struggled with him. No one saw us btiuggling together, ] am quite sure. Ernest Kipping, sworn, stated : I was in the paddock neai the hedge when T heard a gi eat noise. I heaid Pohlen talking violently. He talks (lei man. I heard him bay, " Mien C4ott Sacie norn dedieu." I did not hear " I will murder you."' No one else was about. Pohlen was about 12 chains fiom Thompson's house.

Cross Action. Pohlen v. J. H. Thompson. —Defendant was chaiged with violently assaulting plaintiff. Honrich Pohlen, suoiii, deposed : lam a fainiev and gaidnci lesidingat Harapepe. On the afternoon of the 12th inst. I went to Thoniphon's ]>lace ; his cattle had been in niy place ; T chovo out .some 12 head. 1 went to ask him to keep them at home.; they were destroying my propeity. 1 stood about a raid from his fence, and asked him to keep the cattle away. He told me to go away for an old scoundiel; he took up a stick, came over the fence and knocked me down, and then kicked mo with his heavy boots. (Pohlen .shewed the inaiks on his legs, which shewed seven Inuise-,.) ] shewed the bruibes to the constable next day. To defendant : 1 never thiew lime in your eyes, or you would be blind. I did ashes. You poisoned my dog and cat. To the couit : I have had differences with my neighbours before. Mr McMiun, who is now dead, was one. Constable Gillies said : On Wednesday, 14th inst., Pohlen's son came to mo at Te Avwmmtu, and repoited that his father had been nearly killed by Thompson at Haiapepe. Ipiocceded theie and called him out. He was in bed, but diessed. He said he had been kicked and biuised all over. I told him to shew the maiks, but I could observe none at the time. He then shew ed me his arm. He had some slight scrapes. I told him I could do nothing for him, but he could summon Air Thompson. I said Mr Thompson had already summoned him. The next day Pohlen came to Te Awamutu. His legs weae then bruised nearly as bad as they ate to-day. To Foblen : 1 did not observe that your legi were swollen at Harapepe, but I did the next day. I have had 15 years' experience. Brumes generally show next day. To the com t; I hardly think the braise* shown here to-day could have been caused by the assault on the d.ay stated. J. H. Thompson gave sunilar evidence as in the first case. AH he did was in salf-dafenoe, Plaintiff declined to aak any questions. He would leave it all to the Lord. The court in the first case fined Pohlen £1 and costs, or two week's imprisonment, the court being of opinion that the bruises were self inflicted. The case Pohlen v. Thompson was therefore dismissed.
