CAMBRIDGE TOWN DRAIN. AND AND THE EDUCATION BO ARD).

Ix our report of the, speoial meeting of the Cambridge Town Board hold on Tuesday evening last, it was stated that it was agreed that the board should • meet on the drainage works at the education reserve ye-terday niofning, and in company with ths School Committee investigate the condition of the drain from a sanitary point of view, it having been alleged that it terminated in an open cesspool on the education reserve, from which disease of a deadly nature might .it any moment originate. It will be remembered fi;om the report of the proceedings above referred to that notice was served on the Town Board through the solicitors of the Education Board on behalf of that body to the effect thatj as the drain had been reportccl a dangerous nuisance 1 existing on the education reserve they requested it should be removed within'a certain time, and also that the drain already in existence, , and which had existed for the past four years, should be lifted and removed. , These notices it would seem, had not tlio desired effect upon the board, as (1), they were fully assured of the, fact that the nuisance complained of did not exist outside the fertile brain of the person with whom the statement 01 iginated, and who represented the matter to the board, and (2) that in laying down the ! drain thtough the education roserve, without seeking the' permission of that anjgust body 'they were perfectly within the law, and the Education Board by obstructing the tlrain in any way were not only' going beyond the law,' but were likewise subjecting themselves to the infliction of a heavy penalty for so doing: So long as the boaul i cf rained i from, creating a nuisance by the construction of such diain, , they , hail, nothing whatever to fear. In accordance' withf the- Resolution of the meeting on Tuesday eyening, ;the members of the School Committee and Town Bpaxl met on the ground at'li.3o ycstei day, morning. The outfall of the drain was minutely, examined, and though the drain had been discharging itself here for the past four years, there was not the slightest trace of any offensive matter in the' vicinity, nor the slightest smell noticable. Indeed, unless a visitor to the vicinity was directly .informed of the fact, he would never discover that any drain had an outfall here. It had been alleged that the new draiu recently laid down ori the 'top of the old one carried off the refuse from the brewery, and from the yard of the Criterion Ho^el^but such is not the case. The 1 new drain' merely carries ''off? the storm water which Accumulates in time of, heavy rains at the corner ofßiewery and Victoria-street, 'and- beydiid' this nothing whatever passes through. Thedrainage of the yard of the Criterion Hotel finds an outlet in the' old drain, but on examination nothing . of an offensive nature was discovered to pass into it. Both .the members of* tho School Committee and the Town Board agreed, after a thorough investigation, that no foundation whatever existed for the report regarding the existence of a nuisance. ! Mr Carr ((dhairmah), Messrs Hewitt, , Sargent, and Hosking were present, and the following resolutions ' were unanimously agreed to : "That tho committee acknowledge the receipt of the' Education 1 Board notices in the action against the town board drainage." , ' ' That' this committee has personally visitedthe place or places where the alleged nuisance is said to be created, and that at a- meeting , called for the purpose they have come to Ma following conclusions :— (1) Thatjjio ;nuisance'exists or is likely .ft mise|by.tlic recent action, of \ the <Town Board in opening the drain ; (2) They are* of | opinion tha,t the contemplated action of the Board of Education is not necessary as regards th.e,lfealfcb of 'the scbopl ; (3) They would further, affirm that no cesspit exists, or'ever' 1 has" existed as stated b'y Mr Allright.l ! !
