Wakapatu Mining Company, application for water race. Objected to by G. Pearce, owner of land through which race was being cut. After hearing evidence of A. W. Pollard, and Taraka the Warden granted the application, compensation to be assessed by the Warden to be paid to the owner of the land. - w. Allison, W. J. - Taylor and James McDermott, ordinary prospecting license, Pahia. —Recommended on making arrangements with mortgagee of land. R. Mitchell ; SITTING AT OTAUTAU. MONDAY, DECEMBER 4. The following cases were heard at Otautau on Monday before Mr E. C. Lewev, S.M. —Arrears Of Rent - Mary Ann' Cook proceeded against Henry Morris for possession of a house and arrears of rent, amounting to £44 12s. An order for possession by December 31 was made, together with arrears of rent, costs £1 10s, solicitors - fee £3 2s.

State Advances Department, v. W. Fraser.— An older for possession was made by January 4» 1934, costs 15s, solicitor’s fee £1 11s 6d. —Breach Motor Regulations.— Inspector P. C. Watson proceeded against Janies' Wm Welsh for operating a lorry with timber overhanging contrary to the regulations.—ln inflicting a fine of 10s and costs 12s the magistrate sajd that .seeing this was the first prosecution of the kind locally he would be lenient. The next time, however, he would be more severe.

Jas Broome, was charged with passing round the corner of a public road without keeping as near to the left hand as •was practicable. Constable'' White said an accident had occurred, as a result of which the ear had been badly damaged.—Defendant was fined 10s and costs 12s.

Paterson was convicted and fined 20s and costs 12s, Constable Waite stating that the car had come in contact with the train and had been damaged to the extent of £2O. —Breach of Licensing Act! — Jas Tait- was charged by the police with being on licensed premises after hours and was convicted and fined 20s and costs. .

Robert Daly was charged with exposing liquor for sale after hours and also with keeping his premises open for the sale of liquor at such time as they were required to' be closed. Constable White detailed ithe result. Of liis visit td the Travellers’ Rest lfoteV; Drummond,, and on finding a motor ear outside. Tlie bar and bar parlour were lit up. Tait came walking out of the liar, carrying two glasses of beer in his hand. When interrogated he said he was going to the kitchen, but he brought them back after witness appeared. He was satisfied there were some guests in the kiteheft and one boarder. He examined the boarder’s book in the bar and Tait.’s name was included in the list. On going into the bar parlour the slide was up and the licensee was standing behind the bar. He ascertained subsequently that Tait had informed, the occupants of the car that he had busi ness to do, and they went away without him. He had not had a lot of trouble with defendant except perhaps on sports night, and had never seen anyone get ting liquor there previously. The other men found in the bar were guests. Uonnsel for defendant (Mr Jamieson said that Daly was giving up possessio. the following- day, and several were legitimately staying the night. The licensee was out for a short time, aim Tait had stayed on various occasions with Dalv.
