In the Banco Court, Sydney, a case of importance to persons having dealings with book canvassers was dealt with on March 3. In 1885 P. H. 1 Sullivan signed an agreement to'take the “ Picturesque Atlas ” in parts, at ,5s per number. The agreement coni tained two clauses, the first being to the effect that non-delivery of the work at any specified time should in no way vitiate the contract or release the subscriber from his agreement,and according to the second clause the company agreed to deliver the first number of the work during 1887, other numbers to follow as soon after as possible. Defendant contended that he never heard anything about the work from the time of signing the contract until 1890, when "forty-two parts of the ‘ Atlas,’ along with an account for £lO I 10s, were deposited with him. He resisted plaintiff’s claim in the District Court on the ground that the first volume of the work had not been sent to him during the years specified in the agreement; and Judge M‘Parland, holding that the latter clause in the contract overpowered the provisions of the former clause, gave a verdict for defendant. Plaintiff, on appeal, took the matter before the higher Court, which now decided that, as the two clauses in the contract were at variance, being inconsistent with each other, the former clause, according to a permanent rule of Court, must prevail over the latter, and therefox'e stand as the binding stipulation. The appeal was therefore sustained and the verdict reversed.
