Monday, Bth Mat, 1865. (Before G. Elliott Elliott, Esq., J.P., and J. Carter, Esq., J.P.) DKTJJJKENNESS. Joseph Hart, who had previously given a great deal of trouble, was again brought up on a charge of drunkenness ; fined 20s or 48 hours, and 7 days additional imprisonment for habitual drunkenness. TOWN BOARD BATE. Peter A. Chevannes was sued by the Clerk of the Town Board for recovery of the sum of £5 14s 2d. Adjourned to May 15th. The Board further sued Daniel Mclntyre for rates amounting to £1 13s 4d. Settled out of Court. The same v William Freeman for £2 2s lid. Settled out of Court. The same r T. V. Aston for £1 13s 4d. Amount and costs paid into Court. The same v Archibald Kennedy for £1 13s 4d. Judgment for plaintiff by default. John McKinnon vG. D. Hay garth. No appearance. FELONY. William Prideaux accused a woman, by name ELesiah Cusden, with having decamped with some money to the amount of £8, and other property from his residence. The plaintiff is the proprietor of the Criterion Tap ; the defendant, it appears, was his mistress. During the absence of Prideaux at the Hokitika the alleged robbery was supposed to have taken place. The evidence brought before the Court was unsatisfactory and evidently given with much reluctance. The woman persistently declared that she was the plaintiff's wife, but that he had burned the certificate. The Bench were of opinion that taking all the circumstances into consideration, there was not sufficient proof of any felony having been committed by the woman, so at once dismissed the case, after recommending her to cut the acquaintance of the man Prideaux as soon as possible. ASSAULT AND OBSCENE LANGUAGE. John Blance, adetermined lookingcharacter, described as a seaman, was brought up by Constable Patrick Ryan for having violently assaulted him when in the execution of his duty, and at the same time using most disgusting and obscene language. The eviden ce was conclusive, the constable's clothes were in themselves sufficient evidence of the violence with which the prisoner was charged, and the language as statedin Court, was utterly unfit for publication. After much deliberation, the prisoner was severely reprimanded and fined 30s, — 203 of which was for his violence and bad ianguage, the remaining 10s for the damage done to the policeman's clothes. Patrick Ryan charged William Johnson with having been concerned in the last case andhaving obstructed him when in the execution of his duty. Case dismissed as there was no evidence of the prisoner having taken any active part in the disturbance. A bi'eaeh of the Market Act. Case between Richard Eager and George Biddle was adjourned to the loth May. Edward F. Eager v Richard Barry. Adjourned to the 9th May. Tuesday, 9th May. (Before W. Waring Taylor, Esq., J.P. and Walter Turnbull, Esq., J .P.) Judgment b3 r consent was given in the case of Robert Stains v William Bannister. The case of George Crawford v David Watson for the recovery of a debt of £100 was adjourned to 15th May. DBUNKENNESS. John Williams being brought up for his first offence of drunkenness before the Court was warned, fined 5s and discharged. DISPUTED CLAIMS. McManaway v James Barnes for debt, £26 os. An adjourned case, was re-ad-journed to the 15 th May. Richard Barry who was yesterday sued by Edward F. Eager to recover the sum of £20. The plaintiff on oath stated that he had been put to considerable expense and loss by the defendant having failed to deliver up possession of a house he had agreed to let to him. Judgment for defendant and costs.
