Wellington, in the Province of Wellington, and Colony of New Zealand, buflhen Of Napier, in the District of Ahuriri, in the same Province, Licensed Victualler, of the first part, and James Meliss Stunrt nnd .lolm Gibson Kinross, both of Wellington nforesivid, merrhauU, of the second part, and the several otlier persons whose names and eenls were thereunto subscribed and set, being severally creditors of the said Daniel Munn of third part. After reciting a certain Deed bearing date the said Bth day of October, iBSB, and made between the said Daniel Munn of the one parr, and the sitid James Meliss Stuart and John Gibson Kinross of the other part, being a Conveyance by the said Dauiel Muun to the said .lames Meliss Stuart and John Gibson Kinross, their heirs, executors, administrators, and assigns, of t.ll the real nnd leasehold Kstates of the said Daniel Munn. It waa witnessed that for the considerations in the said Deed of Assi^ninentmeniioned, the said Daniel Munn did thereby aasijm »nd set over unto the said James Melisa Stuart and John Gibson Kinross, their executors, administrators, and assigns, all and every the Stock in Trade, Gooda, Wares, and Merchandise, Household Funiituie, Plate, 1 men, China, Books of Account, Hook and other Debts, sum and sums of Money, and all Horses, Cutile, Sheep, Carts, Dniyh, Whalebortts, and other Boats, and all other the personal Estate and Effects wlintsocver at d wheresoever, of him the said Daniel Munn, in pos- i session, reversion, expectancy, or otherwise (except the wearing oppnrel of the said Dmiie' Munn, and of his wife and children,) upon certain Trusts i.-j the said Deed mentioned, and ninongst other Trusts, upon Trust that if the said Daniel Munn should not on the first day of October, 18}!), pay the several debts in the said Deed of Assignment mentioned and thereby secured, that then the said James Meliss Stuart and John Gibsou Kinross, and the smvivor of ihero, do and shall take possession of, call in, collect, and receive, alt and sins'ilnr, the ronl and personal Estates of the said Dittiicl Munu, pnd sell the same as in the snid Deed of AHfiignmt'tit mentioned.
