Deed of Assignment dated the Bth day of October. 1858, and m'ude between Daniel Munn, formerly of Wellington, in the vProyince of Wellington, and Colony of New Zcalitad, but then of Napier, in the District of Ahuriri, in the same Province, Licensed Victualler, of the first part, and James Meliss Stuart and John Gibson Kinross, both of Wellington aforesaid, merchants ofc^the second part, and the severnl other persons wnose names and seals were thereunto subscribed and set, being severally creditors of the snid Daniel Munn of third part. After reciting a certain Deed bearing date the said Bth day of October, 1858, nnd made between the said Daniel Munn of the one part, and the said James Meliss Stiiart and John Gibson Kinross of the other part, being a Conveyance by the said Daniel Munn to the said lames Meliss Stuart hikl John Gibson Kinross, their heirs, executors, administrators, and assigns, of &11 the real and leasehold Estates of the said Daniel Munn. It was witnessed that for the considerations in the said Deed of Asaignmentmeutioned, the snid Dnniel Munn did thereby assign and set over unto the said James Melisi Stuart and John Gibson Kinross, their executors, administrators, and assigns, all and eveiy the Stock in Trade, Goods, Wares, and Merchandise, Household Furniture, Plate, linen, China, Books of Account, Hook and other Debts, sum and sums of Money, and all Horses, Cattle, Sheep, Carts, Drnys, Whaleboflts, nud other Boats, aud all other the personal Estate and Effects whatsoever ard wheresoever, of him the said Daniel Mupn, in possession, reversion, expectancy, or otherwise, (except the wearing nppnrel of the said Dauiel Munn, and of his wife and children,) upon certain Trusts in the suiil Deed mentioned, and amongst oilier Trusts, upon Trust that if the said Daniel Munu should not on the first day of October, 1859, pay the several debts in the said Deed of Assignment mentioned and thereby secured, that then the said James Meliss StUßrt aud John Gibson Kinross, and the am vivor of (hem, do aud shall take possession of, call in, collect, and receive, all and singular, the real and personal Estates of the said Daniel Muun, ?>nd sell the same as in the said Deed of Alignment mentioned. And we hereby caution aud warn all persons from dealing with the said Daniel Munn, in respect of any of the said real aud personal Estates of the said Daniel Munn, so conveyed and assigned to us.
